of Medford, being an act entitled "An
act to repeal an act entitled "An act

Incorporate the Town of Medford, in
Jackson County, Oregon, and limit
ing its powers and defining the duties
of Its officers," and to repeal an act
entitled "An act to Incorporate the
Town of Medrord, in Jackson Coun
ty, Oregon, approved February 34,
1885, "filed in the office of the Sec
retary of State Feb. 2 1st. 1869, and all
amendments thereof, and to incorpor
ate tha Cltv of Medford. In Jnokitnn
County. Ore., and to define Its pow-j

BE IT ENACTED BY THE PEOPLE
OF THE OITY OF MEDFORD, that
the Charter of the City of Medford,
being an act entitled "An act to re

herein authorized shall not exceed
in the aggregate the par amount of
the warranta or bonds to be paid,
redeemed or replaced and such re
funding bonds shall not provide for a
rate of Interest thereon In excess of ,
6 per annum payable semi-annually.
In the event the said Council
shall be unable to sell sny of the re
funding bond herein authorised at
the par amount thereof and accrued
Interest, the said Council Is author
ized to exchange any or all auch re
funding bonds for any or all the
bonds or warrant to be refunded.
Provided, however, that in no event
shall the par value and accrued In
terest of any refunding bonds so ex
changed exceed the par value plus
accrued Interest of any of the bond
or warrants to be refunded and ex
changed therefor.
(b) All refunding bonds Issued
under thla act shall be In serial form
with- definite maturities and shall
mature in annual or sem-annual in
stallments. The first Installment of
principal shall become due and pay
able not later than five years from
the date of issue and the last Install
ment shall become due and payable
not Ister than twenty years from the
date of issue. The Installment of
principal shall either be equal or
substantially equal In amount to the
combined Installment of principal
and interest due in any year and
ahall be, as nearly as practicable, In
such sums as will permit of an equal
annual tax levy for the retirement of
the principal of and the payment ot
the interest on said bonds.
(c) All refunding bonds author
ized herein shall be of the same class
nnd character as the bonds or war
rants refunded and shall constitute
a charge upon the same character cf
revenues, assessments, liens or other
assets that were applicable to the
payment of the bonds or warrants so
refunded.
(d) All bonds or w.-.rranta refund
ed as hereinbefore provided, shall be
refunded pursuant to an ordinance
duly adopted by the said Council,
which aald Ordinance shall be adopt
ed and take effect the same manner
aa other ordinances take effect. The
ordinance shall set forth the date,
purpose of Issue, Interest rate, ma
turity date or dates and the amount
or the bonds or warrants to be re
funded after application of such,
sinking or other funds to the pay
ment thereof as shall appertain there
to. The ordinance shall also set forth
the date. Interest rate, and the ma
turity date or date of the refunding
Issue, snd shall provide for an annual
tax levy or other revenue with which
to pay the interest on and the prln-t
clpal of the said refunding bond"
as they become due and payable.
