Aryan Law Invoked to De
grade Jews Move Made

trol, Hitler Announcement
BERLIN, April 20. (AF) The Ar
yan law, which bars nearly all Jews
from civil service and degrade them
to second-class citizenship, la being
Invoked In all German universities by
Chancellor Hitler's' cabinet.
Dr. Wllhelm Frlck, Nazi minister of
the Interior, has drafted a law regu
lating admittance of Jewish students
to universities and other Institutes
of the relch according to their ratio
to the entire population. Another
law will assure Nazi leadership of
student organizations.
Chancellor Hitler's newspaper, Voel-
ktscher Boebachter, anonunced tbe
action was being taken to save the
universities from "excessive foreign
control," meaning Jewish.
The Aryan clause defines any per
son having one Jewish grandparent
as a Jew. The only exceptions made
under the civil service ban were Jews
In state service before August 1, 1014,
or those who served In the world war
trenches or whose fathers or sons
were killed In the war.
The cabinet's . action establishes
the new "cleansing" decrees.
SIDESTEP YREKA
YREKA, Cal., April 20. Yreka ap
pears to be facing t&e possibility that
the Pacific highway will not come
through the city at all but be estab
lished on a route either west of the
city or on the east side along Yreka
creek. Dr. W. W. Barnham, state
highway .commissioner stated Tues
day that the engineers who have
been surveying routes through the
city for the purpose of making esti
mates on the various routes, are now
surveying to the north of Yreka tJ
determine the best route as regards
connecting up with the present com
pleted highway a mile north of
town.
Dr. Barnham said that a survey of
a route to the west of Yreka had
been made some time ago, and that
the findings of the engineers would
probably determine the location of
the highway through or past Yreka.

GRANTS PASS, April 20. (Special)
Water has been' turned from the
Savage Rapids dam Into the three
main ditches of the Grants Pass Ir
rigation district. Tuesday afternoon
saw the first water In the Tokay
Heights canal, high line canal and
main canal.
This marks the opening of sum
mer Irrigation activities, the opening
of more gates into a large number
of ditches to follow soon. Late snow
and an abundance of water promise
adequate irrigation facilities for far
mers and ranchers in and around
Grants Pass.

a member of the state Industrial
accident commission to succeed the
late Charles T. Early, way anonunced
by Governor Meier late Tuesday.

The decision whether they will be
tried together or separately, rests with
L. A Banks, former editor and or-
chardlst, and his wife, Edith Rober
tine Banks, Jointly indicted for first
degree murder for the slaying of
Constable George J. Prescott, on the
morning of March 16th, while Banks
was resisting service of a warrant on
an Indictment charging ballot theft.
The two defendants have been advised
by counsel, the matter is one for their
own determination. .
Friends of the accused intimate
that they will face the Lane county
Jury, which will decide their fate, to
gether. The trial is scheduled to start
Monday, May 1, at Eugene. Oregon
law gives them the right to decide.

the trial. The state has announced it
would try Banks first, in the event
separate trials were asked.
Attorney T. J. Enright. one of the
counsel for Banks, said yester
day that the defense would be found
ed upon the general plea of not guil
ty. Under this plea the defense will
have the right to introduce evidence
to show Insanity, self-defense, "de
fense of the castle." and gives them
a wide latitude In the matter of evi
dence. Under the general not guilty
plea the defense can use one, or all
of the possible defenses.
The defense attorney said that be
tween 15 and 20 witnesses would be
called in their behalf.
The state will conlend that Banks
acted with premeditation and with
out Justification, that he was "legally
sane" at the time of the firing of the
fatal shot, that his spoken and writ
ten words, immediately after and be
fore the murder, and his acts for the
same period were rational and sane.
Banks' notes to city and state offi
cials, warning them of "bloodshed,"
and his statement to the state police,
and in theJosephlne, county Jail will
constitute part of the evidence td be
Introduced against him at the trial.
Attorneys of the city and county see
similarity between the Banks case
and that of Dr. Richard M. Brum
field, insofar as legal insanity is con
cerned. Dr. Brumfleld, a Roseburg
dentin slew a hermit by the name
of William D. Russell, to perpetrate
an insurance hoax. He was convicted
and sentenced to hang. Insanity was
interposed as a defense.
In the Brumfleld trial, the Oregon
law covering Insanity as a defense
was carried to the state supreme
court, and upheld In a ruling on an
appeal The Oregon law holds that
Insanity when used as a defense must i
be sufficiently shown, as "dethroning!
reason." and that eccentricities or de-1
luslons of the defendant is not In
sanity within the legal meaning of
the' term. The Insanity under the
Oregon law must be proved "beyond
a reasonable doubt."
Because of the prominence of
Brumfleld in Douglas county, and the
fiendish premeditation. Involved in
the murder of Russell, the trial at
tracted state and national attention.
Brumfleld was arrested in Canada
where he was employed as a farm
hand and made his escape by wear
ing women s garments.

Judge Succumbs
BOSTON, April 20 . ( AP ) Webster
Thayer, the Massachusetts Judge who
pronounced sentence of death upon
Nicholas Sacco and Bartholemew Van
zettl was dead today at the age of
75.
The jurist succumbed to a cerebral
embolism, suffered Friday in his room
at the uillverBlty club here, and his
condition had been too critical for
him to be moved. His wife was with
him irom the time -he was stricken.

SEATTLE. Wash.; April 20. (AP)
A possibility that the embargo placed
upon Russion lumber Imports today
by Great Britain may aid soft wood
lumber export sales In Oregon and
Washington and particularly British
dumb la, was .held out today in a
statement by the West Coast Lum
bermen's Assclatton.
The association, however, pointed
out that Russia, dented the British
market to which she sold 45 per cent
of her exported lumber last year, may
decide to "dump" the lumber else
where, threatening international
lumber trade at other points.
The (4 a thousand import tax on
lumber levied by this country would
not keep Russia from "lumping" a
.half billion feet of lumber In the
states. If she wanted to, In the opin
ion of the association.
If the embargo Is maintained, the
association believes "It may be of
great Importance to the lumber In
dustry of Oregon, Washington and
British Columbia, depending on the
duration of the embargo and the i
amount of stock on hand in Sweden,
Finland and Norway.

ports from three billion to three and
a half billion board feet of lumber
per year and 90 per cent of that
