by his "alter ego" L. A. Banks, files an affidavit of preju
dice against Judge Duncan. This action automatically disquali
fies the presiding judge from hearing the case against Fehl.
A new judge will have to be appointed. Whoever that judge
may be, Fehl will undoubtedly file an affidavit against him.
Thus by taking advantage of
prejudice exists justice will be delayed, and this period of dis
sension and strife, from which this community has suffered so
long, and all right thinking people wish to see terminated at
the earliest possible moment, will be indefinitely extended.
AS WE understand the law, nothing can be done to prevent
such action. ,0nly after exercising two affidavits of preju
dice, can a defendant be FORCED to accept the third judge
appointed, and be brought before the bar of justice.

We will leave it to the fair minded people of Jackson county,
as to whether his efforts to prevent his own case from coming
to trial, in the regular course of legal procedure, supports his
contention, or throws a certain cloud of suspicion and doubt
around it.
Men conscious of their innocence, convinced of the justice
of their cause don't usually resort to legal technicalities to gain
time and delay justice; but are almost always eager to be
brought before their accusers at the EARLIEST POSSIBLE
MOMENT.
AS WE see it the only thing for local authorities to do under
such circumstances, is to appeal to the supreme court and
the higher authorities to cooperate with them, and dispose of
these affidavits of prejudice just as quickly as the legal formal
ities allow. -
' We believe- the people of Jackson county, in spite of fac
tional differences are a unit, in their desire to have these cases
brought to trial just as soon as possible, and the entire unsavory
mess cleared up definitely, ONCE AND FOR ALL, the guilty
punished, the' innocent exonerated.
Only when this is done can Jackson county return to any
thing approaching normalcy, and that condition of peace, pros
perity and well being which WE ALL DESIRE, be realized.
The Prescott Memorial
rE idea that a memorial slab be erected to the memory of
Officer George Prescott, who died in the performance of
his duty , is a good one. There should certainly be some
PERMANENT REMINDER to this and 'future generations of
the sacrifice made by a brave and loyal peace officer, and his
inestimable contribution to the maintenance of an orderly demo
cratic government in this community. .
Before this tragody happened preparations were made for
the erection of a gigantio drinking fountain on the court house
grounds. It seems to us, that to incorporate the idea of such a
memorial in this fountain, would be most fitting.
The court .house not only better symbolizes the lawful
ideal involved than the city park, but the lesson learned at
such a deplorable sacrifice, is a lesson for all Jackson county,
not the city of Medford alone.
Moreover there is something too cold and impersonal about
a granite slab and nothing more. A bronze tablet on a drinking
fountain, commemorating this tragio saorifice, would, we be
lieve, appeal to the people of Jackson county, much more.
Will It Be War ?
SO GERMANY now has its dictator. " Hitler is granted auto
cratic powers. An alliance with Austria is advocated. ' All
Europe is once more seething.

The only hope now is that another Sarajevo will somehow
be avoided. But with super-nationalism rampant, with the
irresistible force of the Old Entente, facing the immovable body
of a revived Alliance, it is diffioult to see how that spark can

However while peace remains there is always hope. Premier
McDonald of Great Britain, more than any other statesman in
Europe today personifies that hope.
He is essentially a man of peace. He thoroughly understands
the extremity of the present situation. He is working night
and day to prevent Europe from repeating its ghastly blunder
of 1914.
He deserves the help and the prayers of all who realize that
another European war means the extinction of European civilization

Give Prescott Boy a Job.
To the Editor:
1 have noticed many suggestions
regarding aid for the family of the
late George Prescott. They are all
good, but may I suggest another one
which appeals to me more than any
yet advanced?
- George had a son about 22 years
ago, an Industrious lad, with a fairly
good education, but fc; a long time
he has been unable to get a Job. When
George was alive he refused to use his
Influence to get Paul a position for
fear It might put some other deserv
ing person out of work. You know
what a fine type of man he was.
It occurs to me that nothing would
help the Prescott family more at this
time than for someone, to give this
boy a Job. I can guarantee his hon
esty and Industry. He spends his
time now caring for hi. Invalid
mother and doing odd Jobs around
the home. A paying position would
do him great good, morally and physi
cally, and help the family. I believe,
as nothing else would. Perhaps print
ing this In your paper would result
In his finding a place I feel this Is
the most Important thing to do at
the present time,
