In about the year 1035 In a flaehy
Cadillac car. bringing promises, in
the California manner, of unlimited
prosperity for the fruit industry ot
the Rogue River valley; pear crops,
oblivious to frost, and millions to
be brought from the land left
Thursday to occupy a cell in tha
Josephine county jail. Police sirens
screamed through the city to mark
his departure. With guard to the
right and the left of him he was
transported to Grsnt Pss before en
raged citizen could do him harm.
. Charged with murder In the first
degret for the slaying of Constable
George Prescott he remain In the
Josephine county Jail today.
Record In the Jackson county
clerk's office show that during the
yeara he haa lived, or held properties
tn Medford, he haa become Involved
In SI civil case and that four crimi
nal charges have been brought
against mm.
It was during the "good years" that
Banks came to Medford. Everybody
was prospering. He bought extensive
landa, paying a little down, giving
mortgages for the remainder. Always

Dally Newa carried optimistic stories
of the agricultural outlook. Quest,
were Invited to visit the plant on
West Main atreet, which boasted of
mahogany furnishings, Gradually a
vein of condemnation began to ooze
tnrougn the lines of the newspaper.
An attack was started against the
farmere- Exchange Co-operative. Env
ployeea of the newspaper were In
formed that their goal waa to destroy
that business. They were sent out
Into the country for etorles, always
with Instructions not to publish any
thing favorable.
Other concern were soon added to
the list of "condemned" In Bsnks'
newspaper. A complete turnover ot
staff was reported at the newspaper,
to be followed by other "houseclean
Ings." Business houses, the mer
chants association, the ministerial
association, state officers, th Ameri
can Legion, county officers, th cir
cuit court, the auprenw lour.t th.
Elk lodge, the Orange, the cham
ber of commeroe and the bar associa
tion were reviled.
In 1030 In the midst of hi cam
paign against practically all existing
institutions he announced hi candi
dacy for tha United State, senate,
opposing Senator MoNary. He met

swer to the Newa Publishing com
pany in the recent suit for recovery
of the newspaper, he claimed that
up to July 1, 1030, he was a resident
of California. It was eight days after
that date that .he filed his acceptance
aa a candidate for the senate. Ac
cording to the Oregon law six
months Is the period of time re
quired to qualify for citizenship.
Following his defeat in the sena
torial race, the barrage of criticism
continued. Suit after suit waa filed
against him In the local courts for
collection of money. Then came act-

elected county Judge. He supported
Gordon L. 8chermerhorn In ttie-prl-merles
as sheriff candidate but threw
him over In the general election to
aupport an Independent candidate,
Lowell Zundell. Schermerhorn waa

Phil Lowd waa highly recommended
aa a deputy sheriff, but when he
sorved nece.vary aummon against
Bank he waa condemned in hla news
paper, and Ralph Jennings, bitterly
opposed by Bsnks, described as a
good sheriff. The barrage of criti
cism aa court casea became more
plentiful centered on the district at
torney and other county officials.
Th Good Government Congress
waa organized to protest against th
officials. Banks wa made honorary
president. i
When Attorney Gus Newbury finally
brought the New Publishing com
pany case Into court, after repeated
delay, on the part of Banks, the lat
ter armed himself with two revolver,,
according to hla former counsel, M. O.
Wllklne and declared, "Now bring on
Ou Newbury."
The newspaper wa returned to th
original owners lea than four year
after purchased by Banka, without
the newspaper through which to talk
he continued his protests through th
Good Government congress, bringing
out weekly newspaper at the Pacific
Record Herald plant.
Thursday to serve a warrant Issued
on a grand Jury Indictment, involving
Banka In the theft of ballot from th
court house vault. Officer Prescott
called at hi home. He wa shot and
killed. Leas than four year after he
came to Medford to make hla home.
Banks left Medford for a jail celt, hi
arrest on a murder charge brlngln
a gruesome climax to hi stormy pe
riod of citizenship here.
