Mr. Blgham was successful In catch
ing several ateelhead, which were
served at dinner last evening.
Make Home Here Mr. and Mrs.
George C. Foreman have arrived at
their ranch near Eagle Point to make
their home, coming here from San
Diego. Mr. Foreman has made his
home In this state since three years
of age. The Foremans have com
pleted constructing their garage, and
are now building a house on their
ranch. Other of their relatives, In
cluding Dave and R, Spurlock, and
Mrs. Ryebolt of Chandler, Ariz., ex
pect to come to this country to make
their homes, Mrs. Foreman aald.

Passing of sentence up on Emalee
(Bobby) Mansfield, 92, and Luther
Crosby, both of Ashland, for alleged
participation In the burglarizing ol
the J. ' C. Penney store at Ashland
July 29. last, was deferred again to
day. Both will enter pleas of guilty,
the district attorney's office reports.
According to the district attorney's
office. Miss Mansfield haa been pa
roled seven times. In her contacts with
the law. She Is charged with receiv
ing stolen goods.
Crosby, who served time at Salem
prison for the robbery of Nelson's
Toggery at Ashland two years ago, has
been the beneficiary of court leniency
two times. He Is charged with burg
lary, and was on parole, the authori
ties say, at the time of the Penney
robbery.
Virgil (Dodo) Burnett, another
member of ths gang. Is 16 years old,
and will probably be remanded to
the Juvenile court.
Lester (Buck) Wilson, the fourth
member of the group, haa been pa'
roled three times, and was released
last January from state prison on
conviction of the Nelson Toggery rob.

The chief Justice of the supreme
court, speaking of Mr. M. O. Wllklns
and his brief filed In the supreme
court In that case, at psge 447 of the
above mentioned case, has this to say:
"Our statute prescribed the duties
of attorneys to be, among other
things, as follows:
"J. To maintain the respect due
the covins of Justice and Judicial of
ficers; "6. To abstain from all offensive
personality, and to advance no fact
prejudtcal to the honor or reputa
tion of a party or witness, unless re
quired by the Justice of the cause

President Hoover today formally ac
cepted hia resignation.
In accepting Pole's resignation, Mr.
Hoover praised him for "the extreme

clerk, wherein he sought a writ of
review, and additional dtfendants. In
his will contest action Involving the
estates of Anna O. Nalley, and Wil
liam A. Pointer, an order denying
both requests was handed down yes
terday by Circuit Judge James T
Brand of Coos county.
The write of review was sought
against Ben E. Harder as executor of
the estate of W. A. Pointer. The order
directs that the costs and disburse
ments be assessed against Nalley.
Nalley sought to have his own at
torney, Quy O. Smith and Porter J.
Neff, attorney for Harder, listed as
defendants.
Further action In the will contest
Is not anticipated until a special ref
eree, named to take the testimony of
will contestants In Illinois, completes
the work.
About 920,000 Is Involved, and the
litigation has been pending In local
court for two years.

Samuel S. Ackley died at the home
of his son-in-law, George Coats, 331
Benson street, early Friday morning
from heart trouble. He was born at
Midway Village, Massachusetts, May
11, 189S and had been a resident of
the Phoenix district since 1025. He
leave one daughter, Mrs. Bertha M.
Coats, Medford. one son Samuel E.
Ackley of Portland, Ore., one brother
Daniel Ackley, Boise, Idaho, and four
grandchildren, also a host of friends
to mourn his departure.
Funeral services under direction of
the Perl Funeral Home will be an
nounced upon the arrival of his son
from Portland.

entitled to disqualify the Judge under
the circumstances: Gen. Laws 1935.

had been well taken plaintiffs would :
not be Justified In filing In this court
slanderous brief reflecting upon
the Integrity and motives of the Judge
who sat in the case. Abuse Is no
argument; culmination la not con-
lnclng; defamation Is not determi
native of an issue; perversion of speech
Is not persuasive. The language quoted
from plaintiffs la very far from being
respectful to the circuit court.
Defendants' counsel suggest that
unless the brief Is stricken they
should have the privilege of respond
ing In the same kind. 'Two wrongs
never make a right." Defendants
should not follow the base example
set by plaintiffs. We think the at
torney for plaintiffs should file an
apology In this court apologizing to
Judge A. L. Levitt and this court for
using the disrespectful language
quoted above from their brief. II

from the date of this opinion, the
brief will be stricken from the files
of this court."
