O. Wllklns In connection with the case of Strowbrklge vs. City of Chllo. quln the reported decision of the su preme court on that case found in the 130 Oregon, page 444, might be of Interest to the voters of Jackson county. The chief Justice of the supreme court, speaking of Mr. M. O. Wllklns and his brief filed In the supreme court In that case, at psge 447 of the above mentioned case, has this to say: "Our statute prescribed the duties of attorneys to be, among other things, as follows: "J. To maintain the respect due the covins of Justice and Judicial of ficers; "6. To abstain from all offensive personality, and to advance no fact prejudtcal to the honor or reputa tion of a party or witness, unless re quired by the Justice of the cause with which he Is charged." Or. L., 1083. "3-3. The brief Is a very flagrant abuse of the duties of attorneys who are public officers as defined In our code, cited above. I Double Bill Shows Craterian Theatre "Is My Pace Red?" with Helen velve trees and Rtcardo Cortez heads fine double bill at the Fox Cra rrlan today and Saturday, j It bares the soul and the activities of a high-pressure columnist & wrecker of happiness, a rorllcklng imp of Satan, who slings his darts at high and low. Irrespective of feelings, blast ed happiness and ruined reputations. Tearing the veil from the myste rious origin of Intensely personal gos sip, the film accompanies the col umnist on excursions Into dives and speakeasies. It accompanies him back stage In Broadway show palaces and Into the homes of the socially elect. With Ita startling revelations. It tolls an absorbing story In which tan gled loves and bitter hatreds play their parts and how the cavalier pen man Is at last triply cornered. "South Sea Adventures," with Zane Grey, the noted author, as Ita star a film that surpasses In thrills and beauty any picture of Its kind ever made Is the second feature attrac tion on the Craterian bill. " Thla picture was made under the direct supervision of the noted author and sportsman on his recent trip to the South Seas. In the suit of P. K. Nalley, against the county court and the county clerk, wherein he sought a writ of review, and additional dtfendants. In his will contest action Involving the estates of Anna O. Nalley, and Wil liam A. Pointer, an order denying both requests was handed down yes terday by Circuit Judge James T Brand of Coos county. The write of review was sought against Ben E. Harder as executor of the estate of W. A. Pointer. The order directs that the costs and disburse ments be assessed against Nalley. Nalley sought to have his own at torney, Quy O. Smith and Porter J. Neff, attorney for Harder, listed as defendants. Further action In the will contest Is not anticipated until a special ref eree, named to take the testimony of will contestants In Illinois, completes the work. About 920,000 Is Involved, and the litigation has been pending In local court for two years. "BackStreeFWins Audience At Holly Medford movie fans have stamped "OK" on Pannle Hurst's "Back Street" according to John Nledermeyer, mana ger of the Holly theater, where "Back Street" Is now showing. "Seldom doe a theater present a picture that gets so much favorable comment from Its patrons as we have received the past two days of the Bhowlng of 'Back Street'," the manager said. Further proof of the approval of movie fans of the screen version of this dynamic story Is the large attendance during It first two days at the Holly. "Back Street" features Irene Dunne and John Boles and presents these two In what Is unquestionably their best roles to date. The exquisite beauty of Irene Dunne, coupled with the touching sequences of the story PASSES, AGED 7 Samuel S. Ackley died at the home of his son-in-law, George Coats, 331 Benson street, early Friday morning from heart trouble. He was born at Midway Village, Massachusetts, May 11, 189S and had been a resident of the Phoenix district since 1025. He leave one daughter, Mrs. Bertha M. Coats, Medford. one son Samuel E. Funeral services under direction of the Perl Funeral Home will be an nounced upon the arrival of his son from Portland. not presented, however, until a mo tion and a demurrer had been pre sented and argued, and the case put at Issue on the facts more than one day prior to the attempt to disqualify Judge Levitt. Plamtiffs were not entitled to disqualify the Judge under the circumstances: Gen. Laws 1935. Chap. 143. But even if the motion ; had been well taken plaintiffs would : not be Justified In filing In this court slanderous brief reflecting upon the Integrity and motives of the Judge who sat in the case. Abuse Is no argument; culmination la not con- lnclng; defamation Is not determi native of an issue; perversion of speech Is not persuasive. The language quoted from plaintiffs la very far from being respectful to the circuit court. Defendants' counsel suggest that unless the brief Is stricken they should have the privilege of respond ing In the same kind. 'Two wrongs never make a right." Defendants should not follow the base example set by plaintiffs. We think the at torney for plaintiffs should file an apology In this court apologizing to Judge A. L. Levitt and this court for using the disrespectful language quoted above from their brief. II he does not do so within twenty days from the date of this opinion, the brief will be stricken from the files of this court."
