DAMAGE CLAIM OF
SALEM, June 14 (AP) The au
preme court today affirmed the
Jackaon county circuit court In the
caae of Charlea Erb, Jr., agalnat
Herman Shope, Coneolldated TrucX
llnea, and the Oregon-Medford truck
line, In which the lower court
awarded a Judgment of S7000 for
personal Injury damagea aa a result
of an automobile collision.
The defendanta appeal from the
..udgment returned In the court pre
sided over by Judge H. D. Norton.
The opinion was written by Justice
Rand. The opinion held that In ad
dition to the Judgment of the lower
court, ctatutea provide an additional
10 per cent for delay In appeal.
The above ault was based upon
an auto accident on the Pacific
highway near Gold Hill one foggy
morning In February. 1930.
Charlea Erb. Jr.. former University
of California football atar. claimed
that the truck driver of the Con
eolldated Truck lines was recklesa
and negligent, and that he sustained
Injuries to his back, which In
capacitated him for duties as a
coach and professional football
player. He waa represented by At
torney George M. HobertB of this
city.
Circuit Judge H. D. Norton waa
sustained by the higher court and
Erb awarded a alOOO Judgment, plus
a penalty of 10 per cent for delay

great decrease In storage holdings of
eggs throughout the country, to
gether with the abnormally alow
and depreased trade, creates an ab
normal situation throughout the in
dustry. Latest storage holdings re
port. Issued by the department of
agriculture, reflects a decrease of
4.093.000 cases In supplies aa com
pared with June 1 a year ago. A
month ago the shortage was 3,180,
000 cases, compared with May 1 a
year ago. This month's figures re
flect a decrease of 5,801.000 cases as
compared with the average for five
years.
Despite this serious low In the
current holding of eggs In store,
there remains a lack of snap In
the market.
Trading trend In the market for
butter was fully steady for the day.
No change was reflected In the
price, either on the exchange or on
the open market. Butterfat values
are well maintained.
