Max OeBauer made an affidavit In
which he declares that Darrell Kuaon
and Mrs. Carrie Walker, who made
affidavits of Mrs. QeBauer's conversa
tion In the "What-Not," informed him
that they signed their affidavits in
the presence of Earl H. Fehl, and not
Attorney T. J. Enrlght as the affldar

Mrs. Francis Campbell, 804 East
Main street, avers by affidavits, that
Mrs. OeBauer did not visit her home
during the course of the trial but ild
call after its conclusion and discussed
the amount of the verdict and Mrs.
OeBauer declared "she had voted for
Fehl for mayor." Mrs. Campbell's af
fidavit contests one submitted by A.
C. Abrama, in which he attributed
alleged prejudicial statements to Mrs.
GeBauer. Abrams declared the con
versation took place on March 7 last;
Mrs. Campbell holds it was March :3,
after the trial. Mrs. Campbell's affi
davit declares, that Abrams said, "I
will do anything for Fehl as he Is
my friend and I would go on his
bond."
Corroborates Wife
W. P. Campbell corroborated his
wife's statement, that Mrs. OeBauer
made no prejudicial statement against
Fehl. Abrams Is a lodger at the
Campbell home.
Attorney Allison Moulton, in
affidavit, denies that Mrs. OeBauer
gave him a confection during the
course of the trial but admits tnat
while in the hall, dnMng a Jury recess

and gave him "two aspirin tablet"
with the comment they had cured her
headache. Attorney Moulton avers
that Attorney T. J. Enrlght saw the
Incident. "Joked about It," and did
not regard it as "misconduct." Moul
ton further declares, "the courtroom
was packed wiht political friends of
the defendant and -laughed and ap
plauded the defendant and his law
yers and If statement was made in
the presence of the Jury, it was by
them."
Saw No Prejudice
Mrs. liatherlne Lathrop of Central
Point, a member of the Jury, asserts
that she was with Mrs. OeBauer con
stantly during the trial, and Mrs.
OeBauer exhibited no prejudice to
wards Fehl by word or act.
John Daugherty of Ashland, anoth
er Juror, makes affidavits corroborat
ing Mrs. Lathrop.
Roy Parr, plaintiff, makes affidavit
denying any prejudice or misconduct
as hinted, and that he confined him
self to perfunctory greetings.
Arguments on the motion for a new
trial, and the affidavits, will probably
be heard by Circuit Judge H. D. Nor
ton, the coming week. No definite
date has been set for the hearing.

noon for a neighbor, whose woodshed
and garage were destroyed by the
flames, Ben Stevens. 52, of Rogue
River, who was well known In this
city, died of heart attack.
He was born In Medford, vMarch
27, 1880, and spont his lifetime In
the Rogue River valley.
At the age of 20 he was married
to Bertha Walden. to whom were
born two daughters, Freda Marine,
Central Point, and Bertha Mae Stev
ens of Rogue River. His wife, Ber
tha Stevens, also survives. He also
leaves his mother, Elizabeth Stevens.
