-A pitched battle between Roy M
Foster. North Umpqua rancher, and
Emroy Davis, who for several years
has been the principal figure In an
attempt to colonize the Fish creek
burn district, was reported today to
Vernon Harpham, supervisor of the
Umpqua national forest.
Foster, running cattle and horses
in the Fish creek district, said he
went to the Cedar Springs camp yes
terday to salt his stock, made a camp
and went to a creek to get water
His path was blocked by Davis who
he said, leveled a pistol at ,11m and
ordered him to take ,11s horses and
cattle and leave the country.

Foster said he rushed Davis, at
tempting to draw his own revolver at
the same time, but the sldearm stuck
In the holster and accidentally dis
charged without Injury to either
man.
The rancher said he threw his re
volver away when the two reached
close quarters, and fought Davis
hand to hand, overpowering and dis
arming him. and driving him away.
The report said Foster Is on his
way to Roseburg to deliver Davis'
pistol to the sheriff. Davis, too, Is
said to be cn his way to Roseburg
from Diamond lake.
Davis recently was convicted in
federal court on a charge of Inter
fering with forest service employes,
and was sentenced to a six-months
term and paroled. Previously, he ftad
been convicted three times for squat
ting and trespassing.

KILLED BY PLUNGE
HOOD RIVER. Ore, Aug. 13.
(AP) Ed Justcnsen. driver of a
gasoline truck, was killed yesterday
iihen his heavv tank truck and
tank trailer loaded with 30.000 gal

guard rail on the Columbia high
way and rolled down a 100-foot em
bankment near Herman creek. His
body was found a few feet from
where the truck crashed througn
the fence.

Bohnert was shown. Programs of
educational value, as well as interest
to the children, have been developed
during recent months.

At the next meeting. August 21,
Mrs. Henderson's gang will perform

Henry Conger gave an -interesting
talk, inviting members to visit the
Jacksonville Grange. A letter pro
testing the proposed Increase in
freight rates was read and mailed
to the Interstate commerce commis
sion.
Following the program supper was
served by the youngest members or
the Juvenile Grange. '
Mrs. Benson Not To
Open Dance School
The Eve Benson Dancing Academy
will not open this season in the Med
ford Center building, according io
announcement yesterday of Mrs.
Benson. Opposition of a tenant to
the noise of dancing feet has necessi
tated this change of plans.
The Benson Dancing academy has
operated in Medford for seven sea
sons, but because of no other suitable
place available will not open this
fall "unless strange things happen,"
Mrs. Benson said yesterday.
Mrs. Benson had planned to attend

Eastern Trout Said
Dying In Fish Lake,'
Group Investigates
Dr. R. E. Green and Olen Arnsplger
of the small streams and lake com
mittee of the Jackson County Game
Protective association are at Fish
lake today to Investigate the report
that Eastern Brook trout are dying
in the lake. They will return to Med
ford tonight with specimens of the
fish to be sent, to reliable biologists
for examination.
The report received by the local
association states Unit dead fish have
been found along the bonks of the
lake end on the screens at the outlet
ln great numbers. They are said to
have white spots on their backs
Indicate that some parasite is attack
ing them.
The Jackson County Game Protect
ive association has reported the con
dition to Matt Ryckman, superinten
dent of hatcheries.
The ' association' has been very
active In the planting of fish
throughout the past year and has di
rected the distribution and planting
of nil fish from the Butte Fulls
hatchery. With the cooperation of the
United States Forestry department
the local group has auBed a great
number of fish to be planted in laktS
in the Blue Canyon country, where
there has previously been no flshtntt.
