BT FALLS SCHOOL c7
CASE NEARING END f g
IN CIRCUIT COURT g
Hearing of testimony In the suit
of William Joe Nee and three
other school teachers against the
Butte Falls school - district iui
$1350, alleged due for non-fulfillment
of contract, was completed
in rh Mr-milt court late yesterday
and hearing of arguments and final
charge to the jury will oe neiu
Monday morning.
Susanna Homes Carter county
superintendent of schools, occupied
the tand yesterday afternoon and
the defense attempted to show by
her that jobs were available in tne
county for teachers after the plain
tiffs had been ousted, and teachers
hired at Butte Fails, and that the
old Butte Fall, school board had
granted the contracts earlier than
usual and before other districts of
the county had similarly acted.
The defense also contended that
the Butte Fallo directors granted
the contract to circumvent tho
county boundary board. An appeal
on the Butte Falls budget was filed
with that body and the school
board let the contracts before any
action could he taken. From doc
umentary evidence read by Mrs.
Carter, 'It was shown that salaries
paid at Butte Falls were higher
than paid In districts of the same
classification, In this county.
Mrs.J Elizabeth Slmmervllle, a
former director wa called in re
buttal by the plaintiffs and denied
that . any undue haste had been
exhibited by the board, of which
she was a member, to Issue the
contracts and denied there was
any "conspiracy" between the
board and the suing teachers.
Mrs. Slmmervllle testified that
all "was peaceful." at the Butte
Falls school board meeting until
Attorney -E. E. Kelly entered the
proceedings a counsel for those
opposed to alleged "extravagance."
The charge brought a sharp ex
change between the accused and
