today, a petition for a rehearing in
the action of It. II. Hollopeter
aguinst V. W. Palm was denied.
The case, dating back several years
arose from injuries the plaintiff
sustained . whe.n .working on u
building for the defendant! Hollo
peter was awarded a Judgment of
jll.Tiifi. The plaintiff was repre
sented by Newbury and Newbury,
attorneys, and the defense by A. 11.
Keames.
Hollopeter sued fur $t 5,000
damages o;i grounds that he was
sent up to work by the defendant
on a defective Hcaf fold, which
broke and sent him to the side
walk, lie sustained a spine injury
from which ho says ho Is never
expected to recover, also suffering
a lame let;. The defense main- !
tallied that Hollopeter cajne under
the workmen's compensation act
and the defendant therefore was
not responsible for the Injury. The
supreme court decision is final.
