IN LOCAL CASE
Tho damage action of Bert C.
Kostel, Central Point, against J. O.
Love, orchardlst and resident of
the samo clly, was expected to be
complete In circuit court this
afternoon. Tho plaintiff Is seeking
$600 as tho result of alleged
killing by Mr. Love or a Lowellyn
setter dog last April. The dog was
owned by the plaintiff and Is
claimed to have been trained as a
hunting animal.
The defendant was on tho stand
shortly beforo noon, admitted kill
ing tho dog and claimed that It
had damaged his property by
chasing game birds, by digging a
hole under the fence nnd by run
ning through his alfalfa field. Ho
testified the dog had made four
such trips and on tho fourth trip
ho went to his house, obtained a
shotgun and killed the animal, as a
protection for the birds and his
property.
On cross-examination, tho de
fondant admitted that he had
killed a dog before. He denied a
conversation that was a part of
tho testimony of Mrs. Bort Hostel,
witness for tho plaintiff, who in
opening tho case told of a convor--satlon
she had with Mr, Lovo when
sho learned that ho was connected
with the death of tho dog. She
testified that tho' defendant bo
camo Irato when she asked why
tho dog was killed and ordered her
off the placo. She denied that sho
had said that, a value of r,0 had
been placed on the dog In tho con
versation. Tho defense claims that
value was placed and the plaintiff
declares that such price, was re
fused without hesitation.
The plaintiff also brought out
that no. complaint had boen made
that the dog was ranging on pro
perty of others and that the dog
was gentle and kindly, was a watch
dog and a general household pet.
Tho defense sot forth that tho dog
was a killer and that It had been
h o o n chasing birds, including
inoadow-larks and molesting nests.
The defendant claimed that the
dog had boen oh his proporty
eight times around tho house, but
had never molested it there.
Sovornl more witnesses wero to
bo called this afternoon. Neighbors
of the plaintiff, testified the dog
barked at night and was a nuls
nnce. A neighbor, Mrs.' Mercer,
testified this forenoon In behnlf ot
the plaintiff that barking had
never dtsturbod her. Mr. and Mrs.
liedgepeth and Mr. Milton, a wood
dealer, wero to testify this after
noon for tho defense.
