WAR. BOOKS HEAD
LITERARY GRIST
OF CLOSING YEAR
nr Hit-Jianl Mi-fiHk-:
(AP FeatiireiServico Writer)
. NEW YORK UP) From an emi
nence of books, rising above tho
mists of patriotic fervor anil n.i
tinnal Jealousies. America-' how in
1029 the bloody European battle
fields of 11 years ago. "
In fiction the year was largely
one of war stories, based on tho
ony too real experiences of their
authors. And out of these were
elevated the major successes of the
publishers' twelve-month, "All
Quiet on tho Western Front" and
'A Farewell to Arms "
Tho phenomenal reception t.c
corded tho simply effective ac
count of a German foot sloggei-V
fate in Erich' Maria ' Remarque's
novel may have been partly re
sponsible for tho big parade of
books that wound up with Ernest
Hemingway's equally unadorned
yet-impressive story of an Ameri
can ambulance driver In Italy and
his love for a nurse.
youth, however, had to share its
honors with the mailers. Of the
later, James Branch Cabell, Ellen
Glasgow, Joseph ' Horgeshoim'-r,
Theodore Dreiser and Mrs. Edith
Wharton ore but a few who exer
cised their perennial talents.
Nor was there any apparent'
slackening of the mystor.y solving
pastime to which a monument i
lifted in the "Omnibus of Crime."
Europe, too. as usual sent ov.-r
a- large proportion of its output ami
also as usual a European'. Thomas
Mann, was decorated with th
Nobel prize In literature.
. But observers of a nation's
reading tastes look' ' upon the
mounting list of non-fiction titles
as the most significant marker "f
a people's Intellectual growth. And
here philosophy and science h:tve
risen to a place --secondary only
to 'biography, of which there never
.has. been a more voluminous 'ex
ploitation. ' . '"
While a' large group was read
ing about Henry VIII. Calvin
Conlidge, Queen Elizabeth. Alfred
E. .Smith, Benjamin Franklin and
Mark "H'inna. others were initiated
Into the mysteries of mind arid
matter by such as Abbe Dimne..
John Dewey, ' Walter Lippmnnn
and Sir James .Jeans, the author
of "The I'niverso Around 1's."
All of this reading hns rcstiltd
In the publication of more than
7, Son titles In one year witli the
peak not yet in sight. And much
of this perusal of the printed pace
is, no doubt, a result of tho book
club stimulus, without mention of
which no summnry of 1 0 2!) would
be quite complete. ' 11
For the book selection contro
versy, with the clubs on one si'le
and a. publisher on the other, v:,s
a lively development -. uf . last
sniing's tempest over! Joan l.nvf
ell's "Cradle of the Deep."
Subsequent Incidents, like the
triumph of Miss Rndciyffo HnllM
"Well of Loneliness" over the cen
sors; the award of the Pulitzer
prize to Miss Julia Peterkln for
her rtegro character study, "Scar
let Sister Mary." after another
book had been seriously consider
ed, or the curious gossip and "con
fession" novels, were unable to
npproach It as a literary sensa
tion. .
Hut altogether they helped make
1029 a year of entertainment and
amusement for a literate America.

nO.UK VPt vV noji- conception of
tho duOe f tbi bar and the rela
tlonnhip between the lawyer nnd
the client has arisen in Ituly anl
made official by an opinion of Al
fredo, Rocco, minister of justice.
The idea obtaining In Amerioy
nnd In England thnt the lawyer
should defend hU. client's Interest
to the . Iit ditch falli to the
ground. The new Idea is that the
lawyer owes hlg first duty to tne
state and his second to his client,
and thnt when his duty to the
Mate conflicts with that to hi.
client, tho, state comes first.
Minister of Justice Itocco R.iyn
that the lawyer should hasten jus
tice and make It sure, even fit hi.
own client's expense. In criminal
cases the accused Is still to be con
sidered Innocent until proven
guilty, but this is not to excuse
the lawyer for Introducing "son
Btuff" and other dramatics Into
the trial.
The minister says ton thnt the
client Is not to rennrd the lawyer
as the docllo instrument of his
wishes, no matter how lenal they
may be. He Is to reenrd tho attor
ney as an organ of Justlre, placed
by the state at his disposition.
Minister Rocco tells the lawyers
that they should outline the points
of a case for themselves before
they flit the suit; control the ex
position of 'the facts as the client
relf.tes them nnd gather the ele
ments of proof so that when th.
case Is called It can go rapldiv
forward to n decision, lie adds;
"The nohle profession of the law
will gather further dignity from
these means. The number of law
yers will be limited by the applica
tion oT the new professional law.i.
The new codes will give to Itallrn
lawyers new functions nnd respon
sibilities. "No dl-apositlon of the future
rodes will wound the just sensi
bilities of the forensic classes.
Discipline Is necessary In view of
the delicacy of the public functions
entrusted 10 them. Hut n scrupu
lous respect will be maintained for
their Independence.'
