him. He went to within 100 yards j
of ihe patrol boat, he said, nnd re-j
celvlng no signal, pursued his !

over to Captain Larsen. an employe
of the American Car nnd Foundry
company, from which he had pur
chased the yacht.
"Shortly after he had taken
charge of that boat," Mr. Fish said
In his complaint, "he turned the
boat directly across Its course nnd
stopped It. On asking him why
ho had done so, he informed me
that the coa.st guard was nhooiing,
whether at us or in the air, I am
unable to say, as we were not hit.
"The coast guard then came
alongside In a very choppy sea and
Insisted that they put a man aboard
to search the boat, covering us with
five or six army revolvers or re
volvers of similar type. The rep
resentative who came aboard
searched tho boat for liquor.
Fish told newspapermen that al
though his wife and two young sons
were present, tho search was ac
companied by a "frightful outburst
of profanity and vulgar language."

a now trial was filed today at the
county clork'H office by tho J)aily
XewH 1'uhlishing company. A judg
ment of $l(0 was returned last
week in favor- of Young, who had
sued for $10,000 on grounds that
he had been injured in I lie eyejj
of the public as the result of the
publication of alleged libelous ar
ticles concerning himself.
The motion for new trial In
cludes five separute counts, cover
ing technicalities in jury Instruc
tion, i and sets forth that tho court
erred In these five counts.
