from Judge Thomas, October JO advertised in the press this
statement :

This statement is intended to give the impression that
a new judge was made 'necessary by the affidavit against
Thomas; and that Sweeney filed an affidavit also against

HE FACTS
Dr. Sweeney did file an affidavit of prejudice against
Thomas January li), but
Thomas on the same day denied tif? luftion for a new
idg! and amongst the reasons sot out in the order is the
following :
"Third, it is notordy difficult to jfrocure the
services of an outside judge at a time convenient to
the local judge, but the distances that outside judges)
obtained are compelled to travel, makes it extremely
expensive. Fourth, iu judicial districts in remote
sections of the State, such as the First Judicial Dis
trict is, a free uA of this character of affidavit would
be destructive to the olorly and efficient procedure
of. court affairs, and because of the delay caused
thereby would deny justice to many."
This order is of record in Volume !3i), pauje 348, Circuit
Court Journal, under date January 20, 1926".

FIDAVrr AGAINST McMAHAN.
MarcH 0, 1920, Newton C. Chancy, district ifttorney,
made and filed an affidavit of prejudice against Judge ilc
llahan in the Sweeney ease. Look at it for yourself, Judg
ment Roll 1973-D. This was four days after Judge Thomas
had by telephone from Grants Pass notified the Chief Jus
tice that such an affidavit had been filed. The advertise
ment would cause you to believe thflt the affidavit wSs
filed by Sweeney.
