Lloyd. 26 year old Cottage, Orove
youth who is fighting to savo him
self from a death penally on a
churgo of murdering- Clint I. Bann
of Independence on the night of
September 1, resumed tho stand at
nine o'clock Tuesday morning to
undergo cross-examination by Dis
trict Attorney Holgerson. Indica
tions are that tho case will go to
tho Jury shortly after noon, practi
cally all testimony except rebuttal
evidence was completed Tuesday
afternoon.
Lloyd took the stnnd In his own
behalf about 4:30 Tuesday. His ap
pearance on tho stand followed tho
resting of tho state's caao and the
ovcr-rullilir of a motion by W. w.
Ilarcombc. defenso attorney, who
sought to have the caso dismissed
on the grounds that while tho In
dictment charged premeditated mur
der the state's testimony had been
to tho effect that, he crime had been
committed In an attempted robbery.
Lloyd admitted freely tho circum
stances of tho time preceding and
following tho killing of Ilaun, but
declared that he had no rccolloctlon
of what had happened between the
time llaun stopped the car bocauso of
engine trouhlo near Huena Vista and
a later period when ho found him
self alone In tho car between Albany
and Salem. He denied part and ad
mitted part of the confession intro
duced by Francis V. Galloway, dis
trict -attorney of Wasco county who
was ono of the leading witnesses for
the state.
Under cross examination Lloyd
talked freely regnrdlng all occur
rences except tho immedlnte time of
