he has not yet received a request
from Oovernor Plorce to take charge
of the prosecutions of District Attor
ney Hlliott of Klamath county. Wil
liam H. Levens. state prohibition com
missioner and L. L. McBride, one of
Leven's aides.
According to Van Winklri, Elliott is
not disqualified to prosecute any of
the cases except the one against him

not qualified to act aa prosecutor by
reason of his indictment.,
Circuit Judge Leavltt, the governor
was informed, has granted an affi
davit of prejudice filed against him
hy Elliott, and an outside Judge will
