BRINGING
I ONE - TOO HOT TO J
AS IRRELEVANT
DAYTON. Tcnn., July 21. (A. P.
'"I 'feel that." tho . testimony of "ftlr.
Bryan can shed no light on any issti
that can be pending: before" tho highGi
courts." the judge said in expunging
Bryan's testimony.
"The issue is whether Mr. Scopes
taught that man descended from a
lower order of animals. I feel that
Mr. Bryan's testimony cannot aid the
higher courts," ho repealed.
"Therefore J am pleased to expunge
this testimony from tho records of
t;hfs court."
' In discussing the court's ruling,
Clarence Darrow said:
,J "We have no proof to offer." ,
;' He suggested that the Jury be
brought In. - ,
' Arthur G. Hays, for tho purposes of
perfecting the record In the event of
an appeal, read a list of the witnesses
the defense would havo offered had
they been permitted to 'do so, and
took a formal exception. ;
He also asked that tho record show
that Scopes had a contract to teach
In tho Rhea county school from Sep
tember 1 to May 1.
"William Jennings Bryan, in discuss
ing the expunging of his testimony
suggested that the views of the de
fense counsel, had not been brought
out as clearly as might havo been.
Dudley Pie Id Malone, for tho defense,,
retorted that members of his side of
the case were ready at any time to
mako their views public when such
an" issuo was germane.
O. B. McKinzlo suggested a 'Joint
debate after the. 'trial was over, and
the discussion ended when the jury
Was ordered brought in. r
