It is conceded, has
richly earned the right to retire. He
is 84 years old. was graduated from
Harvard in 1861, had a brilliant civil
war record, being three times wound
ed, and has served on the supreme
bench since 1902, when he was ap
pointed by President Roosevelt. In
pite of his advanced' age Justice
Holmes Is keen of mind and has long
been known as one or the courts
hardest workers. Latterly lie has
seemed not as robust as usual, but at
the same time he has kept up IiIb end
of the judicial duties in a manner to
cause younger men to marvel.
In view of the age of Justice Holmes
It has been repeatedly rumored In re
cent years that he "would retire. How
ever, the work of the bench Is becom
ing Increasingly burdensome.
Thus far there is only vague specu
lation as to who would succeed him.
Undoubtedly democratic leaders would
urge on the president the appointment
of a democrat, on the ground that the
party Is entitled to another member
the court. This would bring up
such names as those of Senator Under
wood nnd former Sonator Shields of
Tennessee. It would be discretionary
with the president, however, whether
he would name a republican or a
democrat.
