The work of building the new
oatablishnient. which will bo a
modern concrete structure of hand
some design, with a 35 foot front
on Main street and 140 feet on North
Ivy street, will be begun In the very
near future. Inasmuch as this loca
tion Is in the zone which permits
6erv.ee stations, the permit matter
was not referred to the City Plan
ning commission, but wag handled
direct bv the city council, as were

IN JENNINGS CASE
A temporary injunction was Issued
Tuesday by County Judge Hartzull,
upon the application of Kenneth
Forbes. April 27th was set as the
date of the hearing to make the
injunction permunent.
Forbes secured the injunction
against sheriff Ralph Jennings, und
his divorced wife. Hazel Elsie Ray
mond. The sheriff is restrained from
filing any legal action against a
parcel of land owned by Forbes near
Gold Hill, that his former wife may
take, to force payment on nlleged
divorce expenses due.

Inx the appeal to the state su
preme court of William von der
Hcllen and Eugene Dletz. from the
judgment in favor of M. D. Olds,
capitalist and former owner of the
P. & E. railroad, bonds of under
taking were filed nnd approved Tues
day. C. B. Plerson and J. F. Brown
of Eugle Point are the bondsmen.
Olds sued the defendants for $4000
damages, as a result of alleged neg
ligence resulting In the burning of
the Eagle Point depot In Auctist,
1922, on the port of the appellants.
A jury decided in favor of Olds.
