City on December 18 lout was legal,
thft supreme court held today In the
case of the state, by tho district attor
ney of Clackamas county on relation
of William H. Sloan, plaintiff, against
"William Andresen, C. H. Caufield and
Frank H. Cross. The three latter were
elected city commissioners under a
new commission form of povernment
established by the election. The
friendly -proceeding was instituted in
the supreme court to determine tho
legality of the election. The opinion
was written by Chief Justice Mcllride.
' Other opinions handed down today
were:
Emma Harrison, appellant, vs. F.
Ji. . Beals: nppeul from Tillamook
county; suit to collect on promissory
note; opinion by Justice liurnett;
Judge Ueorge It. Bagley, reversed and
case remanded.
Leonle .D. Schmltt vs. Jackson
County Creamery, et al, appellant, ap
f&ai from .Jackson county; suit, in
volving accounting: appeal dismissed
in opinion by the court.
The suit of Leonle D: Schmltt
against the Jackson County Creamery
was for the recovery of ll&OO in stock
and ttn accounting- of the undivided
profits of the creamery. The conten
tions ot the plaintiff were upheld in
the lower court, nnd an appeal taken
to ,the Bupreme court by the defen
dants with the above adverse result.
