afternoon, the court "ruling that Dr.
Johnson had no legal groundB for suit
against the bank.
"The'suit 'was ba'sed upon the pur
chase 'of ''a 'Peerless 'automobile ' be
lbnglnfr to E. H. Lamport, and to Dr.
Joltnnon through A. W. Walker. The
price was J2200. Dl'.'Johnson igave a
Nas'r, ,,car yalued at: $1200 . and a
promissory 'note for '$1000. ' The note
was sold by. Walker to the bunk, 'nnd
nil but about J260 on It was paid by
Dr. Johnson, , when Lamport filed a
claim against the car for money due,
and Dr., Johnson Was deprived, '.the
complaint . alleged, of the use of the
car. iir. Johnson claimed that he ten.
dered the amount due on the note,
but the bank refused acceptance. The
matter was then carried Into court.

the value of the Nash car, money paid
on the promissory note, and damages
for $600 for loss of patients through
