Death was not unexpected, as for
two weeks, Mrs. Jones had been fail
ing rapidly as the attack of paraly
sis from Which she suffered, extondod
to her brain. For several days she
had been too weak to be moved.

Tho suit In equity of tho Oregon
Growers Cooperative association
against J. C. lilrchctt, an Albany, Ore.,
fruitgrower, for fulfillment of contract
for delivery of fruit, was heard in the
Linn county circuit court Tuesday, and
settled lit favor of the Cooperative
association, by the court, after all of
the fruit company's evidence had been
psesented. The court handed down a
decree calling for a specific perfor
mance of the contract, awarded dam
ages for non delivery of fruit last year,
sustained the contract In all particu
lars, and assessed tho cost of uctlon
nnd attorney fees to Dlrchett.
There was considerable local inter
est in tho outcome of the suit, as there
are five suits pending in this county,
all based upon the same grounds.
Blrchett had a contract with the Co
operative association, and attacked its
validity In a suit, falling to deliver per
contract last, year, making it an issue
In court, with the above result, being
overruled In all particulars.
The action was closely watched in
ell tho fruit raising auctions of Oregon.
