PORT OF SETTLE
i WINS Fill IN
SUPREME COURT
' T
WASHINGTON. Jan. 31. The
The port of Seattle won its fight in
the supreme court today for title to
valuable waterway rights in, Seattle
harbor.
Lower court decrees upholding the
claim sof railroads having terminals
on the harbor to riparian rights
through ownership of land adjacent
to the improved harbor were restor
ed, the higher court holding that no
such rights existed under Washing
i ton state laws.
The area in dispute was described
as being 'twlthin the boundaries of
the east waterway in tho. harbor of
a Seattle and lying 'between the west
boundary and the United States gov
ernment pier headline in the water
. way."
WASHINGTON, Jan. 31. The ap
peal of Judge 'lien B. Lindsay of the
Denver juvenile court from convic
tion on charges of criticism of court,
was dismissed today by the supreme
court.
"WASHINGTON, Jan. 31. Tho
Eastman Kodak company today with
drew its appeal to the supremo court
from lower court decrees in the gov
ernment's anti-trust suit against it.
The lower, court decrees, issued in
'August 1916,' provided for . the dis
solution of certain trade commissions
and contracts. The company today
nsked that the mandate carrying out
this decision be issued; at once.
WASHINGTON, Jan. 31 Laws ol
Alaska imposing taxes on byproducts
'of the herring fishing industry were
upheld today by the supreme court.
The opinion of the court was given
in the suit brought by the Alaska
Fish Salting company against Wal-
steln G. Smith, as treasurer of the
territory, to recover $10,000 paid as
taxes on fish oil and fish meal pro
duced by tho company in 1917 and
191S. Tho company asserted that
the tax, under tho guise of a revenue
measure, was imposed solely for tho
purpose of making it impossible for
the herring fisheries to continue in
business.
WASHINGTON, Jan. 31. Con
victlon by court martial of Alexan
der Kahn, Donald Fisher and Robert
L. Lecocq on charges of murder
committed while they were inmates
of the federal prison at Leavenworth,
was uphold : today by the supreme
court. Decrees of lower courts dis
missing writs of errors sought by tho
thre men were affirmed.

HARVEY Why are you surprised
that the modern artist, whether ar

should he attracted to the field of mo

only the contrary would he surprising.
The motion picture of today plays
the roles belonging to kings and
queens of other times. It hns nlmmiv
constructed more palaces than Louis

need of more artists.
One cannot help being attracted to
this form of art so modern, this mode

of expression so new and striking that
already the theater seems vaguely to
belong to the past, and this In spite
of the advantage of the spoken word
and color that the theater lias over the
motion picture.
I believe, though, thnt ihls very ab
sence of the spoken word and color is
Hie reason for the great success of the
motion picture. Tim unspoken dia
logue which each of us Imagines for
himself, the absent colors which we re
place by I hose of our dreams render
our Imaginations more sensitive, more
varied.
It Is for us, tbii arllsls, to make
Ibis dream as beautiful and real as
possible, and In' doing so we realize
our own dreams. And through this
marvelous medium what greater in
liuence can the modern artist have
what better means of expressing a
new thought or a new form?
I see the day approaching when
everything that Is new will be shown
to (he nliblic by the motion picture,

can show one hundred million people
that which in other times It was dif
