1-ark Evans on the charge ot the lar
oeny of G. W. White's cur in 'alleged

bery pf the Grants Pass jitney man,
which was set for trial this forenoon
in Judge Taylor's court, was contin
ued until next Wednesday at 10 a. m.
at the request of the defense because
of inability .of an important witness
for the defense, to bo present today.
Gus Newbury is attorney for Mrs.
Evans, who at her hearing two weeks
ago on the charge Of being an accom
plice of lir husband In the kidnaping
and robbery of White, was discharged
on a technical point of law raised by
Porter J. Neff, who was acting as her
attorney in place of Mr. iXewbury who
was engaged in clrauit court at Jack
sonville that day.' It will be remem
bered that District .Attorney Roberts
then immediately caused her arrest
on the charge of the larceny of
White's car and when arraigned her
hearing was Bet for tcklay.
(Lark Evans, who was convicted of
the robbery of White over two weeks
ago and was sentenced to 15 years in
the state penitentiary by Judge Calk
ins, is still in the county jail as Mr.
Newbury, his attorney at once gave
notice that Evans would seek a new
trinl and was given 30 days in which
to file the formal application, which
automatically stayed he carrying out
of the sentence. 'It is uiulerstcA)d that
the defense has discovered much new
and Important evidence which will bo
disclosed when the motion for a new
trial Is an;ued.'

on the charge of assault to kill, the
warrant for arrest having been issuod
on complaint of I. A. Snider of the
Hlnes &' Snider Auto company. It
Is alleged that during an altercation
between the two men -night befe'ro
last Norris cut 'Mr. Snider on the left
side witli a knlfo. The hearing of
Norjis was set for late this afternoon
before Judgo Taylor. :

breakjng of tho Illinois levee a mile
abovo the high bridge which spans
tho Mississippi river hero had flooded
7,000 acres nt ten o'clock this mean
ing and the overflow of fully 40,000
additional acres lying below the dis
trict first affected cannot be averted.
The flood will create a lake two
miles wide and twenty miles In
length.
The levee, weakened by . waves
which plunged against tho barricd for
days, collapsed without warning
shortly before midnight. The several
hundred families residing in tho dis
trict lying behind tho le'ee had mov
ed out averting any loss of life. Tho
loss to' farmers and land owners will
approximate a quarter of a million
dollars.
