. Germany's military leaders have
used up most of their rescu es in their
attacks sinec Mareh 2 mid the Brit
ish ami French armies, with the re
serve French force, are deemed fully
able to deal with ftirlher enemy on
rushes. The allied strategy is aided
by the fact that tjie Germans must
attack or admit defeat.

It is now i'o weeks since the dis-

mel and in that time the Germans
have gained hardly a foot either in
Flanders or l'ieardy. The French and
British, however, have taken some
small and locallv important positions
in limited attacks, the latest advance
having been made by the French north

Hill 44 and an adjoining farm. It is
felt that the Germans cannot delay
their attacks in strength much longer
and that important seetors southwest
of Ypres nnd between Arras ifnd the

On the Italian front the only fighl
injr is become sharper with the Ital
ians on the offensive. After the suc
cessful operation on Mont Corno,
south of Asiago, the Italians have
wiped out an Austrian outpost on the
important height of Col ltd Orso, be
tween the Brenln and the I'iava. Aus
trian patrol parties were repulsed
north of Lake fiarda and along the
line west of the Hrenta.

hemia, has spread to Galicia and

from the private files of branch of
fices of the Industrial Workers of the
World, containing statements rela
tive to th anti-war campaign, were
introduced by the prosecution today
at the seditious conspiracy trial of
1 LI leaders of the organization.
These letters intended to prove gov
ernment charges that the organiza
tion entered a conspiracy, nation
wide in scope, to block America's war
plans, and told of results mus ob
tained in factories nnd other indus
tries. One letter to Albert 1'rashner, sec
retary of the coal miners branch at
Scranton, I'm., written by an organ
izer who was trying to bring about
strikes in I'enn-ylvnnia, said:
"We are making a grand drie on
the factories with the Icatlct cam
paign, and if the ammunition holds
out, we will In able to give the Imihm1
that which the Germans gave the Serbians,"

scouts yesterday afternoon attacked
a German strong point in the Lnne
ville neetor in which enemy snipers
had a nest and had been oeratine;
with such success that .several Amer
icans had been killed hy their ballets.
The scouts found the point held hy
an officer and 12 men. The party
attacked the Germans, killing the of
ficer and fmir men. The officer's pu
llers, which were ea pi if red, included a
German code and other documents
from which important information
was secured. The scants retired
when German reinforcements appear
ed. Vpon the return of the scouts, 2."

of a patented process for extracting
ore hy flotation, approximately $10,
0(10,000 against the Untie and Supe
rior Mining company for infringe
ment of jMitent, was reversed here to
day in an opinion handed down by
the I'nited States circuit court of ap
jea!s. The decision held that "inasmuch
as the defendant kee out of the
limit Biade for the plaintiff by the
Tniied States supreme court by us
ing more than the critical projxirtion
o foil in the process, they did not use
the plaintiff's process.
The decision was concurred in hv
all three judges in effect, Judge W.
W. Morrow dissenting on a point that
did not materially affect the decis

The Butte and, Kija-rior Mining
company's appeal was taken from the
decision of Jadge G. M, ISnnnniim,
of the federal district court of Mon
tana. Judge iiouniuiin had upheld
the contentions of the minerals sepa
ration eorMration that their patented
process had been infringed and had
granted 10,000,0(10 royalty damages.
The question of infringement rest
ed nimn the proportion of oil used
in the flotation process. The limits
of the invention were one-liaif of one
per cent of oil, nnd tlip JiWision held
that "inasmuch as the lintte and Su
perior company had never used more
than one-half of one per cent of oil, it
has not infringed."
Judge Morrow dissented in this
iwiiii, holding that use of oil exceed
ing one per cent was an infringement.
