purpose of securing signatures of

before mining and smelting opera
tions in this district are again in full

announced that it will reopen all Its
properties just as soon as they are

smelter at Anaconda In full opera

the meeting last night, when resolu
tions declaring for the resumption of

thousand signatures had been secured
and smoltermen were besieging the

In the superior court today on charges
of attempted subornation of perjury
growing out of the conviction of
Thomas J. Mooney for one of.. the
bomb murders In the course of a pre
paredness day parade July 22,1910.
Ten persons were killed.
Oxman, an Oregon cattle dealer,
was a material witness against Moo
ney, whose appeal from sentence .of
death is pending in the state supreme
court, lie is accused of attempting
to Induce F. E. Kigali of Grayvllle,
111,, to give false testimony against
Mooney.
Oxinau's prosecution is in the hands
of deputies of State Attorney-General
U. S. Webb, because of the fact that
attaches of District Attorney Charles
M, Fickert'B office were to be called
as witnesses. Fickert ordinarily"
would prosecute the case.
It was expected that events which
led to charges of "frame up" pre
ferred by Mooney's counsel against
the district attorney's office, and sub
sequent 'public controversy relating
to OiRnau's credibility, would be laid
bare.
' The exiyise of Oxman 's alleged at
tempts tosuborn perjury led to con
sent for a new trial by Webb. The
state supreme court yesterday refused
to, reverse judgment .in a decision
based on this consent, which was sup
ported by formal motion ot counsel
for tho defense. Mooney's appeal on
tho record In the case will be acted
on by tho state supreme court in Oc
tober. PAINLEVE FAILS
PAItIS, Sept. 12. Paul Painlove,
minister of war, has announced that
he has been unable to form a new
ministry to succeed that of M. Elbot,
owing to the eleventh-hour withdraw
al of the socialists, Albert Thomas
and M. Varenne.
M. Painlove went to the Elysee pal
ace at 1 o'clock this morning, where
he was joined by M. Dourgeos and
other statesmen with whom he had
conferred awaiting him at the minis
try of war. He returned within an
hour and announced to newspaper
men that President Pohicore had in
sisted that- ho continue his efforts to
form a cabinet and that ho had asked
for time to think over the situation.
