against the public safety and from
violating the laws of the United States
and of the states and territories there

the president may from time to time
designate by executive order as a pro

and except under such limitations or
restrictions as the president may pre
scribe; (8) An alien enemy whom the
president shall have reasonable cause
to believe aiding or about to old the
enemy or to 'be at large to the danger
of the public peace or safety of the
United States or to have violated or
about to violate any of theso regula
tions, shall remove therefrom with
out permit, or shall repart from the
United States if so required by the
president; .
'(9) No alien enemy shall depart
from the United States until he shall
have received such permit as the
president shall proscribe or except
under order of a court, judge or jus

summary arrest by the United States
marshal or his deputy or such other
officers as the president shall desig
nate, and confinement in such peni
tentiary, prison, jail, military camp
or other place of detention as may be
directed by tho presldont.
"This proclamation and tho regula
tions herein contained shall extend
and apply to all land and water, con
tinual or insular, in any way within
the jurisdiction of the United States."

thence north 75 degrees 39 minutes

That tho grantee shall perform its
work of construction, maintaining
and repairing said canal In a work-
nianliko manner and shall do no un
necessary dauiago to the adjacent
premises; Hint said canal Bhall be
constructed and shall be at all
times maintained in a uniform
grade, so that when not in use no
stagnant water shall stand or remain
therein; and that said irrigation can
al shall never become a nuisnnco to
persons being or residing upon the
adjacent premises, and that plaintiff
shall construct and at all times main
tain suitabto fences and hog gates
across said right of way and canal,
where tho same enters nnd departs
from the premises of the defendant
