It, 3-18) reads as follows : "Section 1, Any structure re straining the waters of any river or stream, which structure is in such n comlition of unrepair ns to be n men ace, to life or property, is hereby de clared to be a public nuisance. Fpoii direction of the county court of tlie county in which such structure is sit uated, the county attorney shall bring suit in the circuit court to abate the nuisance. The proceeding- shall be instituted as n suit in eoiiity and shall be in the name, of sn.-li county as plaintiff, and shall name the owner of said structure as defendant. "Sec. ''. If it appears from the evidence submitted (hat such struc ture is in such a condition of unrepair as to be a menace to life or property, the court shall issue a warrant di rected to the sheriff rcquirimr him forthwith to abate the nuisance, at tin' exiieiisc of tl wncr, and return the warrant as soon thereafter as may he, with his proceedings indorsed thereon. The expense of abating the nuisance may be levied hy the sheriff on the property of the defendant, ami, in this respect, the warrant is to be deemed an execution against nrop erty. With senate bill 711 pending for its consideration, the house this morning pnssed Kcpre senlntive Peck's bill providing for the sterilization of the I'ccblc-ininded, in sane, epileptienl, habitual criminals, degenerates and perverts, n measure similar to the senate bill, by a vote of 37 to 18, five member's being absent. The bill is more drastic than the one from the senate. 11 provides for n state board of eugenics, composed of the state board of health, Ihe superin tendents of the Oregon and the east ern Oregon hospitals, the feeble minded institute and the penitentiary. This board will have the power to hold invest ig-nt ions and make orders. The senate hill leaves Ihe question to u board of alienists in the county court, and Ihe putiinl may take an appeal to the circuit court, but the measure passed by the house pro viiles for no appeal from the decision .of the board.
