Fresh chocolates at De, Voes.
Work is progressing at tfte site of
the Applegate Lumber Co., mill. A
crew of men were put to work Mon
day with scrapers, excavating for the
frames for the concrete mil footings,
which are neing made. The mill ma
chinery will arrive early next week
and will be temporarily housed until
the frame for the mill is erected. It
is thought tlie machinery will be in
plare and ready for operation by the
first of February. Stock subsf-ribers
are paying in their subscriptions very
slowly.

Butte and Superior Mining company
is today resisting in iederal court a
motion to Increase tin bond under
v. hlch it is operating the oil flota
tion process of reducing its ores, to
the amount of a possible judgment
covering royalties resulting from the
use of the patent. A suit against the
company by the Minerals Separation
1 company, limited, of London la now
pending In the supreme court of the
( niteil States in which royalties are
demanded as the result of the use by
the company of the flotation process
of treating refractory ores.
Allegations made in support of the i
i application for an increase In the
company has been disposing of its
enormous assets and war profits in
"excessive divident disbursements to
uoelt holders and in negotiating sale
or merged of its properties to the
American Zinc company in order to
defeat a possible Judgment which
may be rendered against It for In
fringement of patent." ,
The Butte and Superior company
now has given bond in the sum of
$7.1.000 to protect the Interests of
the Minerals Separation company, but
attorneys for that concern allege that
should they secure judgment for in
fringement of patent, their claim
would amount to a very much larger
sum.
