THE LAND GRANT DECISION
THE derision of Judge AVolverton in the Oregon land
grant case, holding' the railroad entitled to an equity
of $2.00 an acre and no more, confirms the interpretation
of the supremo court decision made hy the Mail Tribune
which was Uatly contradicted by the Portland Uregon
ian and other organs of predatory privilege striving to
protect the railroad and enrich it with something belong
ing to the people under court decree.
Governor Withycombe, in order to help the railroad,
called a land grant conference of representatives of vari
ous sections and industries and recommended agreement
upon a program whereby the railroad would be able to
secure, in addition to the $2.50 an acre, a division of tho
proceeds from the sale of the property at its present value.
The conference failed to make a single demand to protect
the interests of the state. Its entire efforts were to aid
the railroad.
Notwithstanding Judge Wolverton's decree, Governor
Withycombe is still striving to present the railroad with
soino'$8,000,000 more than itis entitled to under the de
cree. A report of the proceedings of the land grant confer
ence held Friday reads:
It wiib decided to submit to representatives of the Southern Pacific
railroad n proposition that the company should receive J2.50 an acre for tho
grant lands, plus tho amount of tnxos In oxcobb of l-'.r.O per aero that has
been paid. This excess Is between l!.UUU,O0U and $2, .,00,000.
Various propositions wero discussed, tho most liberal one being that
or (lovcrnor withycombe, who thought that tho company should ho reim
bursed for Its administration expenses In connection with the lands, excess
taxes and the cost of carrying troops In tho past, and that there should
be a sinking fund of $2,000,000 to rclmburso the company for carrying
troops In the future. Tills would glvo tho company about $8,000,000, and,
as the governor figured It, would lenvo about $12,000,000 for tho state.
Why give the railroad anything more than it is en
titled to under tho court's decree lias not the refusal
of tho railroad ,to live up to the terms of the grant already
cost the state tremendously by retarding development?
Why rob the state to reward the railroad for breach of
faith?
Again wo ask, does Governor Withycombe represent
tho people of Oregon or tho Southern Pacific railroad?

than 2700 acres. Aside from this tho Itoguo Itlvcr, Merlin, I.oland, (Jlon
dale and Wolf Crook sections, all of which are directly tributary to Ci rants
Pass, mill over 200 acres, leaving approximately uso acres to the credit or
Gold Mill, Central point and Medford combined.
On December 0 the Oregon-Utah Sugar Co. published
a list of accepted signcd-up sugar beet acreage in both
Grants Pass and Medford papers, showing !l(if)il acres in
approved contracts, of which 102(5 (lary between IWogue
K'ivcr and (Herniate, the Grants Pass 'district, and 1727
between Gold Hill and Ashland, the Medford district.
In addition, the Medford beet committee submitted
contracts enough to bring the total up to 15200 acres of ap
proved land for this section, contingent upon the factory
being located between Gold Kay and Ashland, which were
rejected because the company required unconditional con
tracts. There is no question but that the available acreage is
in sight to justify a sugar factory in this end of the valley,
and perhaps am whore in the vallev
