under shall bo redeemed by a spe
cial and limited tax levy In nddltlou
to tho limitation of the tucs and lev
ies provided by Section 03 of the snld
City Charter.
The- people of the City of Medford
do ordain as follews:
Section 1. That the Charter of
the City of Medford, Oregon, be nnd
the bnine hereby is amended by
uddint; thereto the following sectien:
Section 139. a) Tho City Council,
under thu power vested In it by tho
City-Charter of the City of Medfotd,
and especially sections 05 and 78 or
snld Charter, may levy a special pave
ment and street Improvement tax not
to exceed eighteen mills on the dollar
on the taxable property within tho
corporate limits or the city at tho
time of making out tho annual bud
get as provided for by this charter,
and ns a part of tho total city levy.
Said tax levy shall bo special and In
addition to the ten (10) mill tax
limitation contained in section 05 of
thlu charter, and the money from said
special levy shall bo kept In a separ
ate fund and be used for constructing
Mich street pavement, and maintain
ing such pitteiuent ns Is now or may
hereafter be constructed, and not
otherwise piovlded for; and for re
payment of paving assessments here
tofore paid under assessment ordin
ances or said city as hereafter provld
ed; and for redemption purposes, nnd
for no other purpose. Tho City Conn
ell shall not lay down or construct
any pavement unless the money to
pay for the same Is eltT on hand
or a tax lovy has boon made to pro
vide the same.

for the sale of said Issue or any part
inereot and to pay the cost or making
said refunds nnd redemptions, out of
ine proceeds or the sale or said bonds.
That out of the moneys derived from
the sale of said bonds, the city coun
cil shall pay off, discharge nnd cancel
nH'bonds and evidences of Indebted
ness outstanding against the said
City or Medford ou account of tho
construction of nny of tho pavement
mentioned In paragraph (b) of this
section. After the cnncellntlon nnd
dlECharRo of all tho aforesaid Indebt
edness, out of the remaining moneys
derived from the sale of snld bonds,
there shall be repaid to all property
owners entitled thereto, who bnvo
heretofore paid into the city treasury,
by themselves or their grantors, such
sum or sums an may have been from
time to time paid by thorn or their
grantors on nccount of the construc
tion or assessment of said pavement,
together with those who have paid
by private subscription for nny such
public pavement; provided, however,
that such special assessments were
levied or such prlvnto subscriptions
woro raised, and suck payments wora
made to pay for pavement construc
tion abutting on property subject to
general taxation. Attcr tho period or
one year from tho dnto of tho sain of
said bonds nny of the proceeds from
thu sale thereof remaining on hand
shall revert to tho paving fund pro
vided for by paragraph (a) ot this
section nnd shall be used as said
funda aro authorized to be used eith
er for construction, maintenance or
for refunding or redemption purposed
for the purpose of fully and complete,
ly carrying out tho purpose and In
tent ot this amendment.
(o) For tho purpose of securing
and paying off tho bonds authorized
by this section the city council Is
hereby authorized and directed to
make an annual tax lovy upon the
taxable property within tho corporato
limits or the said city, sufficient to
meet the nnnual Installments or prin
cipal and accruing Interest on tho
bonds authorized by this section,
which lovy shall be In addition to and
free from the limitation of lovy or
indebtedness provided by said city
charter.
(H Tho city council shall have full
power and authority to provido for
tho method or proving clnlms for re
minds out of the proceeds or ald
bond issue nnd paving hind created
heroin, nnd for ascertaining and de
claring to whom rofitmlH shall be paid
hereunder and the amount thoteof;
subject, however, to review by nny
court ot competent jurisdiction, and
said council Is prohibited from mak
ing nny refunds or payments under
this amendment except upon verified
claims against tho city dul made and
presented.
(g) Nothing contained In this sec
tion hhnll be construed to nuthorlzn
any refund or payment for tho con
struction of any prlvnto pavement
olther upon private property or In
any of the public streets, alleys or
other public places of tho City of
Medford, or to authorize nny refund
or puymont for tho construction ot
any pavoniont other than Ib defined
In paragraph (c) of this section.
