npHE loiin1 delayed law suit which will decide, bv the
JL Federal court, fhe status of a contract eiltered into
eiht years ago between the City of .Mod ford and Condor
Water and Power company has been argued' and sub
mitted. A point of law has been raised by the oily at
(orney and he has advised (he council that ponding the de
cision of the Federal court any action taken by thf coun
cil relative to the granting of a franchise for the distribu
tion and salo of electricity by any second company is il
legal. This question of law is concurred in bv pracfieallv
all of the attorneys in the city and it is quite evident that
no action can or will he taken by the council at the meeting
called for this evening other than to lay the proposed
franchise matter on the table.

the street lighting contract with the California-Oregon

Whatever .may have been the misunderstandings

pany eight years ago, should not deter the present council
from meeting with and discussing, along friendly lines,

benefit the city.
Two things are very evident; one is that the California
Oregon Power company is'here, and the! other is that it
has an abundance of electric energy to serve. Willing
ness to negotiate a new deal at this time should be taken
advantage of by the city council for it for the public good
and in the interest of us all.
