CANION HELD 10

Jl
Attorney W. J. Canton was bound
over by Justice of tho Peace Dox nt
Jacksonville this morning to the
grand JiirV, under $1000 bonds, ilp6n
a charge of criminal depravity.
The defense, conducted by Attor
ney (Sua Newbury was based upon
the alibi, that Mr. Canton whs eat
ing lunch In Jacksonville n half mile
away at tho time of tho alleged
crime, and that upon the day In ques
tlon. he wore a light suit and Panama
hat. Instead of a black hat and dark
suit. A general denial of the charge
was made by Major Canton.
The state Introduced but two wit
nesses, Isaac Coffman, the allcgee"
victim, who alleged he received 1?
cents from Major Canton, and told of
tho crime, ntul John Opp who testi
fied that he was a witness to the
crime. In contradiction of this, the
defense declared that Coffman was
showing Major Canton to tho Kino
hart mine, nnd that he was loft ai
tho point whore the trail Joins U
railroad track.
Prosecutor Kelly declares bsur'l
the assertion ot the defendant that
tho case Is the result of a poltlcal
plot, or of personal enmity and says
that he was exceedingly loth to bring
tho charge, spent a day In Its verifi
cation, and was simply fulfilling the
duties of his office, regardless of per
sonalities. Mr. Canton gave the Mall Tribune
the following statement, requesting
Its publication;
In the Issue of the Mnll Tribune
of yesterday, you saw fit to comment
up the chnrgo against me filed by
Mr. Kelly and I presume at his In
stigation, as It his usual custom to
try his cases In tho newspapers, nnd
to say ho was a comrade In the
Phllllplnc war, and that I rose from
tho ranks to major In a crack regi
ment, and a whole lot of slush, all of
which is false except that Mr. Kelly.
I understood served in tho signal
corps In tho Islands.
From the evldenco taken In th
hearing of this case today, It seemed
absolutely certain that n grave mis
take had ben made In reforenco to
me. and that tho matter charged and
being puBhed was done for the pur
pose of destroying mo and my busi
ness In this city. It wasconcluslvr
ly shown that I was eatfhg my"'Iftnch
In Jacksonville at the tlmo that the
state's main witness charges I was
committing a crlmo about a half
mile from thcro.

GRAND JURY UPON
IMMORAL CHANGE
SaaiZS?
The Justice of tho peace beforo
whom this mutter wns heard, seemed
to havu had his mind mado tin prior
to M hearing to hold the matter
over to tho grand Jury Irrespective of
tho conclusive proof to thft contrary
It was currently reported ester
day by Mr. Kelly, so I nin told,. that
'l wns ouro to be held to tho grand
Jury.
I am absolutely nnd entirely Inno
cent of this false elinrge which was
shown conclusively by tho testimony
taken at the Hearing, and 1 eagerly
await the notion of tiio circuit court
In this matter to show this conspir
acy against me to be faked up because
I was active In the recent primary
election for a good nmn for one of
trie county Offices.
Several of the lending attorneys of
this city ypstonlny moriiltiR on hoar
tug of this Infamous chnrgo against
nte Immediately tendered their ser
vices gratis to liie. for which I thu"'
them all very sincerely. Among tho
first was Mr. Otis Newbury who con
ducted the hearing nd will respect
ively refer you' to him for n confirma
tion of this slaiumcnl. t
A squnre deal,! all I ask and as n
reputable newspaper you should con
cede this.
If Mr. Kelly bus been mislead In
this rase by other parties then It may
be he Is not to blame, but I Jud
his actions nnd associations In this
matter frohi his procedure.
