local option Is, of courso, a perfectly
legitimate ono, and you aro entitled
to n very frank answer. 1 -would

self-government and believe, that
every self-governing community

social and moral and aro not sus
ceptible of being made parts of a
party program. Whenever they have
been made the subject matter of
party contests, they have cut the
lines of party organization and party
action athwart to the utter confusion
of political action In every other
field. They have thrown every other
question, however Important, Into
the background and have made con
structive party action Impossible for
long years together. So far as I my
self am concerned, therefore, I can
never consont to have the question
of local option made an Issuo be
tween political parties In this state.
My Judgment Is very clear in this
matter. I do not believe that party
programs of the highest conse
quence to the political life ot the
state and of the nation ought to be
thrust on one side and hopelessly
embarrassed for long periods togeth
er by making a political Issue of a
great question which Is essentially
non-political, non-partisan, moral
and social, In Its nature."

A ordlct of not guilty was re
turned by the Jury In the trial of
former Mayor Kugcue K. Sehniltx
here this afternoon at the direction
of Judge l.uwlor. When the case was
called this afternoon tho situation
which caused tho continuance of the
trial fiom lust Wednesday remained
practically unchanged.
District Attorney Klckert assured
the court that no action had been
taken on the motion to dismiss the
indictments ponding before Judge
Dunne, and Attorney Sclilcslngcr,
representing Abe Ritef. stated that
his client was still determined to
stand on his constitutional right and
refuse to testify until the indict
ments had boon dismissed.
Judge Uiwlor then said: "Under
the circumstances I am legally re
quired to bring this trial to a close."
The district attorney then moved
that tho Jury be directed to leturn
a verdict of not guilty as no evi
dence has been produced either dur
ing this trial or before the grand
jury connecting Schmltt with the of
fense chnrged, that of giving n bribe
to former Supervisor Andrew M. II
son, In connection with the gas ordi
nance scandal.
Judge l.uwlnr addressed the jury
at length recanting the law touching
on the matter, and informed tiiciu
that even should they exercise their
prerogative and return a verdict of
guilt y he would be constrained to set
it aside.
The jury retired and after deliber
ating three minutes returned a ver
dict of not guilty. .
In charging the jury. Judge Lawlor
said:
"Even if the testimony of Aliraliapi
Knef had been presented, no delicate I
question would hae been presented
because he is a direct principal or ac
complice under the law and would
have added nothing to the testimony
alrendv offered."
