I noticed in n, recent isue of your
paper you plead, again for u "city
beautiful," nnd which, since our short
residence, I have read several ties.
.All praise to tho Jfnil Tribune; keep
at up. Having traveled in almost
every state in the union, I think I feel
iomctent to draw comparisons. I
also wish to !-ny, from the literature
sent to the people of the cast, most
beautiful, green, verdure clad sur
roundings arc pictured. Imagine oftV
disappointment when arriving and
going over' the'-eity, stieh a lack of
shade trees that it is rather dt.-cour
ngtng. That livctt add to a city's
beauty cannot he denied.
Many easterner, like ourselvus,
read of the beauty of the city along
with its advantages and some bore in
hopes of making it their home. Xow,
do not put me down as a kickor, far
rather sny u hoostor, for if I would
not prefer to boost, it would not fcig
nify whether or no there wore trees.
The climate certainly is fine I
lovo Oregon and regret thai all my
life has not been bpent in this

Tho supreme eourt evidently doesn't, intend there shall
bo any road building in southern Oregon. Two veal's ago
it decided in the Crater Lake road case that the state could
not spend any money hero, despite the fact, that tho legis
lature had appropriated $100,000 for it. exhibiting its
(Solomon like wisdom by declaring that (rater Lake, one
of the famed natural wonders of the world, was a local
affair. Now, on another pretext (almost any would do)
tho county is stopped from spending its own money in
highway construction.
A story is told of a boy who had spent the day hunting.
Toward night ho was seen running at full speed after a
rabbit, and was asked what luck ho had had. Ho shouted
in reply: "If I eatch this one and four others, I will have
five." This boy was a real optimist and it takes .just
such an optimist to secure any satisfaction or comfort out
of the supremo court's road bond decision.
Tho people of Oregon, according to the supreme court,
did not. vote to amend the constitution so that counties
could build highwavs as they thought thev were doing-
hut simply to enable the legislature to enact legislation
that will permit counties to act, or if the other construction
of the decision is coriect, and

At the same time that the court held that an enabling
act was necessary to make the highway amendment effec
tive, it decided that no enabling act was needed to make
the tax amendment effective. Yet in the oue case the
people A'oted clearly with the intent of making possible
the construction of highwavs, and in the other case with
tho misunderstanding that the amendment simply abol
ished the poll-tax.
There is no telling how the Oregon supreme court is
going to decide. In many cases it takes a narrow literal
interpretation of the constitution. In other cases it takes
a broad construction and legalizes open violations. When
the welfare, progress and development of the state are at
stake, as in the road bond case, or in the Crater Lake case,
it takes the narrow view. "When such momentous occa
sions come before it. as raising its own salary and enlarg
ing its membership, it takes the broad view.
Article 7, Section 10 of the state constitution provides
that there shall be "three justices of the supreme court."
Article 13 states that "tho justices of the supreme court
shall each receive an annual salary of $2000" and Article
4. section provides that the sessions shall be held at
Salem. Yet the supreme court which decided against the
road bonds consists of five justices, each drawing $1000
a year and holding sessions in Pendleton as well as Salem
each separate violation having been sanctioned by the
eourt itself as constitutional,
Who knows what the supreme court decision means?
Attorneys differ and it will evidently require still another
decision to elucidate it. And the elucidation will be in
the light of the past who can guess? Two and two may
bo held to make four or we may be learnedly informe'd,
with judicial precision, in fine sounding phraseology, that
the solution may depend entirely upon the presentation of
the problem, or perhaps such an'authority as Jones Higher
Mathematics may be called in to settle the difficult prob

We may be informed that in the light of well estab
lished precedents since "the
man runnetli not to tho contrary" that "whereas, one aild
one make two it indubitably follows that two and two
inevitably make four." "It is true, however," quotes the
learned judge, "that Lord Coke in a divorce proceeding
made two out of what had been formerly one, but we think
the more established and equitable rule ft that two and
two make four. Vigilantibus non Dorieutibus."
In Maloney versus Me.Ginnity the authority cited by
the learned counsel for appellee a somewhat different rule
is stated but in the light of more recent decisions on tho
subject we are of the opinion that the rule stated in that
authority was not well considered, the case will therefore
1)0 reversed and remanded for a new trial."

ment where they eat their lunches in

erly. At the Jucksoa school the floor of
the irls' toilet is covered with rain
water which has seeped through the
walls, making it lu'co.-sary to lay a
plank on blocks in order that the
room may he entered without step
ping into water from a half to an inch
deep. Throughout the basement water
has seeped, making it most unsani
tary. At the Washington school the toi
lets are also rcxrted to he in a very
unsanitary condition.
