TIE recall movement against. Judge Coke in Douglas
comily, booanseof his instructions to a jury in the
MtiOlellan trial, is deplored by many friends of the recall
as an abuse of the privilege They allege thai, in ibis
particular instance, the recall is based upon insufficient
grounds. Nothing dishonest or fundamentally wrong is
charged.
The Coke recall movement is probably the result of
a factional fight and only the pretext behind which lurk
the real reasons personal and partisan enmity and uis
satisfaction more or less Jieneral.
This is a matter that concerns only the people of
Coke s .indicial district. .U this recall movement is un
warranted and uncalled for. it will be rebuked at the
polls, and Judge Coke re-elected. If his course as judge
has been unsatisfactory to the. people who elected him
and pay him for administering justice impartially, they
will exercise their right of recall.
It is rare that the majoritv of the people do an inten
tional injustice. The American public believes in a square
deal and if Judge Coke is retired, it will be because a
majority believe that he has not given a square deal on
the bench.
But because the recall may have been uuwarranily in
voked in one instance, does not affect the principle at all.
There is nothing sacred about a court that places it on
a pedestal above humanity, and no reason why a judge
should not be amenable to the same laws that the rest
of mankind are. The people that create him, have the
right to remove him.
If Coke does not deserve the recall, he will not be re
called. But there are many judges that do deserve it,
many who are the creatures of political bosses and cor
porations, who have sacrificed their honor as the price
of office, and it is for such that the recall is intended, for
those who abuse their power.
The recall is, above everything else, a constant re
minder to public officials that they are the servants of
the people and that their masters are not to be contem
ptuously defied. The California courts brazenly defied
the people as well as the cause of justice in the protection
of crime in the Schmitz and Ruef cases, until forced by
public opinion to seize any pretext and reverse them
selves. Had the recall then existed, this condition would
never have arizen.
Philadelphia offers another good case for the recall.
Judge AViltbank reeentlv ruled that the Reading railwav
could legally sell as much, decomposed and impure food
as it desired, but private citizens could not do so. The
court ruled that the guilty agent of the railroad, was but
an employee, and his act, being in the line of duty, was
really the act of the corporation. But the railroad, he
further held, was not responsible because it did not. speci
fically order the goods in .question sold, the employe hav
ing been furnished with printed instructions directing
him in a general way how to perform his duties. So that
he knew what to do without special orders.
It is for the prevention of such cases as these, that
the recall, or rather the fear of the recall, is designed.

Senator Chamberlain will have
two appointments to make to the
naval ueademy at Annapolis between
now and March I 'J, lUI'J. He desires
jo open the doors to any young men
in the statu who have ait ambition for
admission to the navy.
The University of Oregon through
its president, has kindly consented
to superintend a tentative oxnuunu
tion whenever sueh examination is
held, and Senator Chamberlain in
tends to appoint the two young men
to the navy academy who are eor
tified to him by the president of the
unixersity us linwmr passed the best
physical and mental examination.
The examination will be held early
next ear at the stale university,
and the two young men who receive
the npoiu(mcut as principals will
then have to stand the examination
under the auspices of the naval
academy on the third Tuesday in
April at a point to be dcMguutcd by
the navy department.
The senator is particularly anxious
to make this notice as general as
tossibk, in order that young men
who contemplate standing' the exam
ination may begin thus early to pre
pare themselves.

Out of its banks the Rio Grande
today is cutting n new river bed

32,000 acres of land,

from n point at the western intersec
tion of Jeff Duvis county, then south
ward and into its original bed about
35 miles below this point in Presidio
'county.
FLORIDA has set an example that should he followed
bv Oregon and all other states by passing an act
regulating fruit brokerage. It is designed to curb, if
not put an effectual stop to produce brokers and coin
mission merchants of wild cat and get rich quick pro
clivities. The measure regulates the business of fruit and pro
duce brokei-s and commission merchants, provides a rule
of evidence in connection therewith, a penalty for the
violation thereof and a rule for civil damages in suits
against offending brokers or merchants.
The law compels commission men receiving fruit
grown in the state for shipment or consignment, to make
return of an account sales showing the cost and expenses
charged against the returns, together with the name and
address of the purchaser with in ten days of the stile
and provides a penalty not to exceed $000 for viola
tion. The statute also makes the commission broker liable
for damages for loss by reason of delayed account stiles,
when he has failed to comply with the law. The loss a
shipper or consigner may sustain on fruit consigned to
the commission broker over what he could have obtained
in other market or by other agencies, shall be considered
approximate damage from the delayod account sales. The
measure of damages shall be the difference between the
prevailing price in the general market at time of receipt
by consignee and the price received for such cars or less,
consigned to said commission merchant between the time
the account sales were due and the time received.
