& Cotton's Annotated Codes nnd Stat

Tho city of Medford doth ordain ns
follews:
Section 1. Whereas, tho city of Med
ford lms heretofore duly caused certain
streets of Bald city to be Improved, and
has duly assessed the cost thereof to
tho property benefited thereby In ac
cordance with tllo charter of said city;
And whereas, certain owners of sun
dry pieces of property each assessed for
such Improvement In a sum exceeding
twenty-five dollars, havo duly inn do and
filed application to pay said several as
sessments In Installments In nccordanco
with section 8727 of said Bellinger &
Cotton's Annotated Codes and tSntutes;
And whereas, an assessment and bond
lien docket has been duly made up In
nccordanco With tho provisions of said
section nnd of section 2728 of said Codes
and Statutes, nnd the total amount of
unpaid assessments for such stroet Im
provements nnd for which application to
pay under the provisions of said sec
tions above cited has been mnde and
filed as aforesaid In tho sum of 18,000.00
as shown by snld bond lien docket;
Now, therefore, snld city of Medford
dotli ordain ns aforesaid that thero Is
hereby authorized to be Issued the bonds
of snld city In tho total amount of

The contractor shall look for payment
only to the fund reserved, collected nnd
paid Into tho city treasury for that pur
pose and will not require tho city of
.Hertford by any lecnl orocess or other
wise, to pay the same out of any other
fund, except ns provided for by tho char
ter, unless said city shall fall or neglect
to provide such funds by valid assess
ments tinon tho property affected. And
the contractor further agreeB that he
will submit a bona fide offer of par and
nccrued Intorest for all water main bonds'

Upon the completion of tho improve
ment upon these stroets. according to
tho contract, tho city shall forthwith
accept the work done and performed by
the contractor and this contract shall be

formed considered consummated, and tlie
city shall forthwith proceed to create
tho Hon provided for by law, upon tho
property bejioflted by such Improve
ment, unless such assessment shall, huvq
been previously created and levied.
Tho contractor shall receive warrants
to the, amount or oignty tuj per cent
of the work completed each mouth and
warrants for tho balance of twonty (20)
per cent shall bo Issued upon the com
pletion of the contract; said warrants
to be redeemed from the sale of Im-
firovomont bonds, or from monoy paid
nto tho particular fund upon which said
warrants are drawn.
It is further ngreed that tho said par
ty of tho first part, tho contractor above
named, shall furnish bond for tho faith
ful performance of mis contrnct, to bo
approved by tho mayor of said city, In
tho sum of fifteen thousand dollars
($15,000.00), guaranteeing the faithful
performance of tills contract and fur
ther providing for tho Indemnifying of
said city against any claims or liens for
labor, work or materials on account of
all sub-contractors, material men, la
boierH and others furnishing labor or
material on this contract.
It Is further agreed that said work
shall bo commenced and prosecuted with
nil reasonable 'diligence and dispatch,
and that all of said work shall bo com
pleted on or beforo October 1st, 1911.

property benefited hy such improvement
