cil and Challenges Validity of Re
peal of Ordinance Reopening Sun

ASHLAND, March 31. Contend
ing thnt Saturday's referendum vote
was illegal and that tho city ordi
nance closing theatres and places of
amusement is still in effect and must
remain so, Attorney P. W. Moore,
representing the Sunday closing fac
tion, appeared before tho city coun
cil unci challenged the right of the
city fathers to declare tho Sunday
clo&ing ordiuiuico repeuled.
In addressing tho mayor and coun
cil, Mr. Moore declared thnt tho law
distinctly provides that all referen
dum measure must be filled with the
city recorder within 10 days after
tho passngo of an oidiuanco by the
council and its approval by the
mayor.
"This is insisted upon by tho law,"
said Mr. Moore. "The people are

tho referendum on a measure. In this
case they did not do so within the
specified time and it is plain thnt tho
elcotion was illegal and void.
"The ordinance closing all places
of amusement on Sunday, was ap
proved by tho mayor on Pebruary
11 and if the advocates of an open
Sunday wanted to resort to the ref
erendum they should have dono so
on or beforo Pebruary 21 in order
to comply with tho provisions of the
initiative and referendum law. In
stead they slept on their arms and
filed no notice whatever wtih thu re
corder tuitil March (i, after tho ordi
nance had gone into effect. We
maintain that it was palpably con
trary to the law."
Tho mayor and council took the
matter under advisement.

Little City Is Forging Rapidly Ahead
and Wiping Out Traces of Recent
Fire New School Will Cost Over

Talent is rising like a Phoenix
from its ashes, and the business sec
tion which was destroyed by fire is
being rapidly rebuilt with larger and
more substantial buildings.
Bids huvo just been let for tho new
school building. Snooks & Trover,
the Salem contractors who are
building thu now school building at
Ashland, were tho successful bidders.
The building is to bo a tw-slory
structure of cherry-red brick and
pressed brick finish. It will cost
$2:i,17f and is to bo one of the finest
school buildings in tho valley. It
will have a basement and will bo
equipped with olectrio lights and all
tho modern conveniences.
The school will bo located on tho
six-aero tract opposite Andrew
Weidner's place. This site was pur
chased last spring and will bo tin
ideal one for school purposes. The
school will bo built this summer.
Tho Odd Fellows are planning to
put up a two-story concrete- building
9()x4.r feet. Tho downstairs part will
bo used for storo purposes, while tho
upstairs will bo reserved for lodge
purposes and business offices. It is
to be located on tho corner of Main
and I streets nnd the plans have
boon submitted to the lodge, but have
not yet been approved. It is oxpect
