GRANTS PASS FOLKS
WORRIED BY DELAY
No Work Being Oono on Ament Dam
Owlnu to Litigation and Citizens
Worry Over Irrigation.
0 RANTS PASS, Or., Feb. 3. - It
will bo remembered that at tho last
term of court the ciio of William
Zimmerman et al. vh Tho Golden
Drill Mining company camo up bo
foro Judgu Ilanna, at which tiinu
four demurrers wero argtiud. Prac
tically two dayri woro taken up in tho
argument of the four demurrer
which were argued all at once, A. K.
ItonmcH roprchciiting tho phtiiitiffrt
and A. ('. Hough and II. I). Norton
the defendant. Tho demurrcro wuro
to not awido tho prenent receiver, G.
II. Saudorn, on the ground that tho
court here had no jtirixdiolion, uh
tho Golden Drift wn an Arixoun cor
Kratiou, that the bond of thu re
ceivor bo iucreiiHed and that a local
man bo apKiiiited oh receiver. The
HiibHtance of the demurrers wuh pub
linhcd in this paper some weeks ago,
at the time they were filed.
As stated, tho demurrers were ar
gued at the January tenn of court
and Jiidtfu Ilanna took the same un
der advisement and before leaving
tho bench be overruled the demurrer.
What tho next move will bo in the
game is hard to tell, hut it is likely
that at tho coming adjourned session
which will couvono on February 14
with Juduo Calkins presiding, that
further petitions will bo filed, but if
what nature they will bo is not yet
known. Thoro is no work being done
on tlio dam al the present time, and
many in this city arc somewhat wor
ried about the condition it is in, somo
beliovinu' that if high water comes
this fcprug that considerable damage
will he done to the dam and pumping
plant. The present receiver is not in
a position to go on with repairs un
til his richt in the matter is firmly
cstahliMucd, lint since Judge Ilanna
has overruled tho demurrers it is
possible that be will again put a
force of men to work at the Golden
Drift.
