Lumber mill nnd raino operators in
Spokane look upon tho decision of
tho federal court for Northern Idaho
in its new ruling on mine timber as
tho most far-reaching' that has been
handed down in years. Tho court
found the Bunker Hill nnd Sullivan
Mining company guilty of willful
trespass and gave judgment to tho
government for $3307.
V. M. Mcsscngor, a homestead en
tryman of Kellogg, Idaho, sold that
amount of timber from his claim nnd
then relinquished. Tho court ruled
that tho homesteader cannot hide be
hind the statute of .878 nnd remove
limber off tho lnnd. oven after a min
ing claim has been located on land
subsequent to homestead filing. It
was held that while tile law in ques
tion permitted the removal of timber
from mining land for mining pur
poses it cannot be construed to cover
the removnl of timber from land
taken, as a homestead. Thero aro
scores of similar cases in Idaho and
other stntes in the northwest.
