o f governm ent tim b e r to the S ierra
Sugar Pine compauy, a C alifornia cor­
poration, will shortly be concluded in
San Francisco by C hief F o rester
H enry S. G raves, who is due to arriv e
th ere on S eptem ber 28.
The tim b er, which stands in the S i­
e rra national forest, has already been
aw arded, a fte r public advertisem ent,
but, under th e term s of the ad v ertise­
m ent, th e c o n tract will not become
binding until the company has been
shown on th e ground w h at tim b e r the
governm ent will reserv e in order to
provide for reproduction, and as
agreed in w ritin g to th e term s im ­
posed.
The company will be allowed to cut
in full 800,000,000 feet, b u t it will
not be allowed to cu t clean. As a
rule, th e F o rest Service reserves about
one-third of th e stand.
“ Such larg e and long-term sales are
a new developm ent of the serv ice,”
said C hief F o re ste r G raves. “ G reat
bodies of m atu re but inaccessible tim ­
b er can be p u t on th e m a rk e t only if
sale contracts are le t on term s which
w ill ju s tify a very heavy in itial in­
vestm ent in tran sp o rta tio n facilities.
In e n te rin g into such contracts, how­
ever, special safeg u ard s to p ro tect the
public ag a in st monopoly and to pre­
v en t an undue speculative profit to the
purchaser are employed.
“ The national fo rests contain the
eq uivalent o f nearly 600,000,000,000
fe e t of tim b e r now o f m erchantable
size, besides young grow th fo r fu tu re
harvest. Because o f its rem oteness
from m arket, only a sm all percentage
can now be sold on any term s. The
sale of less th an one-fifth of 1 per cent
of o ur to tal supply to one company
leaves plenty o f room for com petition
by o th er companies.
“ The tim b e r w hich has been sold to
th e C alifornia com panies lies well
back in the S ierra N evada m ountains
and will req u ire the construction of 70
m iles of standard gauge railroad to
open up th e area.
The company is
given a c u ttin g period o f 22 y ears to
rem ove th e tim b er, besides an addi­
tional two y ears for th e construction
of logging and m an u factu rin g facili­
ties.
“ For several y ears th e F o rest S er­
vice has been selling in the neighbor­
hood of $1,000,000 w orth o f national
fo rest stnm page each y ear, hut this,
combined w ith w h at is cu t for free
use, is only one-eighth of w hat m ight

all U nited S ta te s atto rn ey s, is urging
prom pt ami vigorous prosecutions of
any persons found violating sections
238, 239 and 240 of the new crim inal
code, w hich provide conditions under
which in to x icatin g liquors may be
shipped from ( ne s ta te to another, or
from a foreign country into the U ni­
ted S tates. These sta tu te s, however,
do not apply to shipm ents en tirely
w ithin a sta te , th a t being a m a tte r
over which the Federal governm ent
has no ju risd ictio n . The law s in ques­
tion do not un d ertak e to p rev en t the
shipm ent of liquor into “ d ry ” sta te s
or “ d ry ” tow ns, it having been held
by the courts th a t the governm ent
cannot in te rfe re w ith le g itim a te in­
te rs ta te commerce.
The th ree sections named, however,
are designed to be an aid to the au­
th o rities of a “ d ry ” s ta te or tow n, in
th a t they enable th e s ta te and local
au th o rities to learn w henever liquor
en ters th e ir ju risdiction.

crim inal code, to which the atto rn ey

“ so labeled on the outside cover as to
plainly show th e nam e of th e con­
signee, the n atu re of its contents and
the q u an tity contained th e re in ,” and
any person who ships liquor from one
sta te to another in violation of th is
section— th a t is, ships it in packages
not m arked as required shall, upon
conviction, be su b ject to a fine of not
more than $5000,
and
liquor so
shipped shall be fo rfeited to th e Un­
ited S tates.
Section 238
prohibits
officers,
ag en ts or employes of railroad com­
panies, express com panies or other
common c a rrie rs from d eliv erin g any
package containing in to x icatin g liquor
to any person o th er than the person to
whom it has been consigned, except up­
on the w ritte n order in each instance
of the bona tide consignee, and also
prohibits the delivery of such pack­
ages to any fictitious person o r to any
person under a fictitious nam e.
Vio­
lation of this section subjects the
g u ilty p arty to a fine not exceeding
$5000 or im prisonm ent for not more
than two years, or both. T his section
also applies only to liquor shipped
from one s ta te into another.
The th ird section, No. 239, provides
th a t any railroad company, express
company, o r o th er common c a rrie r, or
any o th er person, who, in connection
w ith the tran sp o rtatio n o f any in to x i­
c atin g liquor from one s ta te to an­
other, shall collect the purchase price
or any p a rt thereof, before, on or a f­
te r delivery, or shall in any m anner
act as the ag en t of the buyer or seller
of any such liquor, for th e purpose of
buying or selling o r com pleting the
sale thereof, save only in th e actual
tran sp o rtatio n and delivery o f the
sam e, shall be fined not m ore than
$5000.
