A sufficient contest affidavit having been
filed in this office by J, W. Wiles, con
testant, against homestead entry No. 10059,
made November 23, 1901, for SW NE,'(,
S'2 NWV. NWtf NWtf, Section 4,
Township 1 N., Range 26 E. V. M. by
Con Welch, Contestee, In which It is
alleged that said Con Welch has wholly
abandoned said tract, that he has changed
his residence therefrom for more than six
months since making said entry; that said
tract Is not settled upon, and cultivated by
said party as required by law; that said
alleged absence was not due, to his
employment In the army, navy or
marine corps of the United States
in time of war. Said parties are hereby
notified to appear, respond and offer evi
dence touching said allegation at 10 o'clock
a. m. on January 4, 1907, before J, P.
Williams, a U. S. Commissioner, at his off
ice In Heppner, Oregon, and that final
hearing will be held at 10 o'clock a, m. on
January 11, 1907, before the Register and
Receiver at the United States Land Office
in The Dalles, Oregon,
The said contestant having, in 'a proper
affidavit, filed November 2, 1906, set forth
facts which show that after due diligence
personal service of this notice can not be
made, It is hereby ordered and directed that
such notice be given by due and proper
publication.
