ant, against homestead entry No. 13467,

Township 2 N., Range 26 E. W. M. by
Hugh Magee, contestee, in which it is al
leged that said Hugh Magee has for a pe
riod of more than one year wholly aban
doned said tract of land and has wholly
failed to reside upon, cultivate and Improve
said tract of land as required by law; that
said abandonment, failure to reside upon,

that said alleged absence was not due
to his employment In the army, navy
