A sufficient contest affidavit having been
filed in this office by D. T. Bogar, contest
ant, against- homestead entry No. 13467,
made May 9, 1904, for SE Section 6,
Township 2 N Range 26 E. W. M. by
Hugh Magee, contestee, in which It Is al
leged that said Hugh Magee has for a pe
riod of more than one year wholly aban
doned said tract of land and. has wholly
failed to reside upon, cultivate and Improve
said tract of land as required by law; that
said abandonment, failure to reside upon,
cultivate and improve said tract still exists;
that said alleged absence was not due
to his employment in the army, navy
or marine corps of the United
States in time of war. Said parties are
hereby notified to appear, respond and of
fer evidence touching said allegation at 10
o'clock a. m. on October 5, 1906, before
W. B. McAlister, a notBry public at his.
office in Lexington Oregon,, and that final
hearing will be held at 10 o'clock a. m. on
October 13, 1906, before the Register and
Receiver at the United State3 Land Office
in The Dalles, Oregon.
The said contestant having, in a proper
affidavit, filed July 27, 1W6, set
forth facts which show that after due dell
gence personal service of this notice can
not be made, it is hereby ordered and
directed that such notice be given by due
and proper publication.

Adda Parrish, Contestee, in which it Is
alleged that said entryman has never es-
: tablished residence upon said land; that
; there are no improvements of any kind ex
! cept asmall cabin about 10x12 ft., without
floor," partly battened, no window, upsn
door without lock or latch; no furniture or
furnishing of any kind; and also with the
exception of an old sheep shed about 180x
20 ft; that land is in its natural state with
out cultivation and is unfenced and open to
j the public range; that said failures to reside
upon, cultivate and improve the land still
exist; that said alleged absence was
not due to her employment in the army,
navy or marine corps of the United States
in time of war. Said parties are hereby
I notified to appear, respond and offer evi
dence touching said allegation at 10 o'clock
a. m. on October 6, 1906, before W. B,
McAlister, a notary public, at his office in
Lexington, Oregon, and that final hearing
will be held at 10 o'clock a. m. on October
13, 1906, before the Register and Receiver
at the United States Land Office in The
Dalles, Oregon.
