A sufficient contest affidavit having been
filed in this office by John W. Brumbaugh,
contestant .against homestead entry No.
11529, made October 7, 1902, for NE.
Section 26, Township 1, N. ftange 26, E.
W. M., by Thomas H. Doty, Contestee, In
which it Is alleged that said entryman has
wholly abandoned said land for more than
six months last past; that said entryman
has not at any time made and established a
residence upon nor cultivated or caused to
be cultivated any portion of said tract nor
made any improvements thereon; that said
alleged absence was not due to his employ
ment in the army, navy or marine corps of
the United States in time of war. Said
parties are hereby notified to appear, re
spond and offer evidence touching said al
legation at 10 o'clock a. m. on January 13,
1906. before W. B. McAlister, a U. S.
Commissioner, at his office in Lexington,
Oregon, and that final hearing will be held
at 10 o'clock a. m.' on January 20, 1906,
before the Register and Receiver at the
United States Land Office in The Dalles,
Oregon.
The said contestant having, in a proper
affidavit, filed November 22, 1905, set forth
facts which show that after due diligence
personal service of this .notice can not be
made, it is hereby ordered and directed
that such notice be given by due and prop
er publication.
