Defendants.
To each of the defendants above named, and each and every person owning or claiming
to own or having or claiming to have any interest whatsoever in the hereinafter described
real property.
IN THE NAME OF THE STATE OF OREGON:
You, and each of you, hereby are notified that Umatilla County, a duly organized
county of the State of Oregon, and the Plaintiff above named, is the owner and holder of
a certain certificate of delinquency, issued on the 12th day of November, 1938, to said county
by its Sheriff and Tax Collector; Said certificate, numbered 2452, covers all real properties
appearing on the tax rolls of Umatilla County upon which taxes have been delinquent for
more than three years from the earliest date of such delinquency and two annual instal­
m ents'of such delinquent taxes, each such instalment being one-quarter of the taxes of the
earliest year or years of delinquency, have not been paid in compliance with Chapter 5, Ore­
gon Laws Special Session, 1935, as amended by Chapter 96, Oregon Laws, 1937. The total
amount shown by said certificate of delinquency to be due and owing against each parcel
of real property described therein includes all taxes for 1937 and prior years which were
unpaid and delinquent at the date of the issuance of said certificate; such certificate so
Issued to said county was filed by the Sheriff and Tax Collector in the office of the Coun­
ty Clerk of said county, on the 12th day of November, 1938, and constitutes and is a public
record open to the inspection of all persons interested therein.
The names of the person or persons appearing on the latest tax roll in the hands of
the Sheriff and Tax Collector of Umatilla County at the date of the first publication of
this summons as the owner or owners of said properties, and if unknown, so stated, fol­
lowed by a description of each of the separate parcels of property, together with the total
amount of each of the delinquent taxes for 1937, and all prior years, with interest there­
on to November 15, 1938, are as follows:

The county committee on soil
conservation met here February 17,
with committee members from Irri-
gan and Boardman, to discuss the
1939 soil conservation program.
Farmers wishing to come under the
program must file sheets of Inten­
tion for the coming year. Those
present at the meeting were M. C.
McDonaldson, state executive from
O. S. C., County Agent Conrad, Har­
vey Miller of Heppner, Jack White
of Irrigon, Paul Smith, W. A. Baker
and Almon Geiss, of Boardman.
Parity payments made in 1939 to
wheat growers who keep planting
within their allotments will be 11
cents per bushel, according to word
received by the state AAA office at
Corvallis.
Payments will be based on the
normal yield of each farmer's allot-
ed acreage. Present estim ates are
that wheat farmers of the nation
will receive $64,113,000 In price
adjustment payments during 1939.
Besides these parity payments,
farmers who cooperate in the AAA
farm program this year, and stay
within their acreage allotments, will
receive
agricultural
conservation
payments at rates previously an­
nounced.
Counting both price adjustment
payments and conservation pay­
ments, wheat farmers cooperating
in the 1939 program will be able to
earn up to 28 cents a bushel in com­
pliance payments, it was said.
Parity payments are made under
the Price Adjustment act of 1938,
which allocates $212,000,000 to he
paid producers of wheat, cotton,
corn, rice and tobacco— ithe nation’s
five basic crops— If their average
prices fell below 75 per cent of par­
ity during the year.
Meanwhile, the Oregon state of­
fice of the AAA continued this week
to handle the huge flow of compli­
ance forms from the 1938 conserva­
tion program, which will bring ap­
proximately 30,000 applicants as
estimated total of three million dol­
lars in payments. Checks are being
sent regularly to county AAA of­
fices, for distribution to farmers.
The trend toward increased co­
operation with the national farm
program continued during 1938, a
comparison with the two previous
years shows. During 1936, Oregon
had 14,496 cooperators who received
$1,817,235 in conservation pay­
ments. During 1937, this increased
to 23,618 cooperators who earned
$2,183,203 in payments.
Although
Oregon’s
compliance
earnings showed this district in­
crease in 1937, some of the north­
west states, including W ashington
and Idaho, showed a decrease.—

pany, Its successors and assigns,
the right, privilege and fran­
chise for erecting, maintaining
and operating an Electric Light­
ing and Power System, and
erecting and maintaining poles
and wires in, upon, along and
over the alleys, streets, public
grounds and thoroughfares, for
the purpose of supplying cur­
rent for electric light and power
to the City o> Hermiston and Its
inhabitants, with the right to
charge and receive payment
therefor, at rates approved and
on file with the Public U tilities
Commissioner of the State of
Oregon, and providing for for­
feiture of franchise for failure
to comply with the terms of the
ordinance and fixing the date
for the expiration of this fran­
chise.
The City of Hermiston does or­
dain as follows:
Section 1. That there he and is
hereby granted to said Hermiston
Light & Power company, its succes­
sors and assigns, the right, privi­
lege and franchise to erect, main­
tain and operate within the City of
Hermiston, Oregon, an electric light­
ing and power system, and the right,
privilege and franchise is hereby
given to said company, its succes­
sors and assigns, to locate, place,
build and maintain In and along the
streets, alleys, lanes, public grounds
and thoroughfares within the City
of Hermiston. Oregon, poles and the
necessary braces and stays, with the
necessary cross arms, and thereon
to fasten the electric wires, and to
stretch said electric wires over,
along, through and across said
streets, alleys, lanes, public grounds
and thoroughfares, and to use the
same for the purpose of transmitting
electric current for lighting and
power purposes, and to have and to
hold such franchise for the purposes
and uses herein enumerated, or In­
cident thereto, and upon the terms
and conditions herein set forth, for
the period of twenty-fire years from
the date of the adoption of this or­
dinance by the Common Council of
the City of Hermiston, and the max-
! Iranm charge for supplying electric
current to the Inhabitants of Her-
i mlston, shall be the rates fixed by
the Public U tilities Commission of
Orevon, or other state rate fixing
body.
Section 2. That the Hermiston
Light A Power company. Its succes­
sors. and assigns be, and the privi­
lege is hereby granted to It, its suc­
cessors and assigns, to furnish said
¡electric lights and power and to
lic ground or thoroughfare upon
which the said poles are erected,
and all poles shall be placed in the
ground to a depth to secure safety,
and no poles shall be erected which
are less than six inches in diameter
at the top end, and such poles and
wires stretched thereon shall be
erected and at all times maintained
in a safe and careful manner, and
shall In no manner interfere with
the natural growth of shade trees
along the streets of said city, nor
prevent the planting and growing of
shade trees upon such streets, except
that the grantee, its successors and
assigns shall have the right to prune
the tops of such shade trees when
the limbs thereof come In contact
with the wires, but shall do no un­
necessary damage to such trees, and
shall prune in such manner as the
Common Council may from time to
time direct.
Section 5. That when It shall be­
come necessary. In the erection or
maintenance of said lighting system,
to take up or remove any portion of
a street or sidewalk, or te dig up the
ground in a street or alley, or dis­
turb any pavement which shall be
placed
thereon,
then
the said
grantee, its successors and assigns,
shall without delay, replace such
street, paving or sidewalk, in as
good condition as it was before, and
whenever it shall be necessary to
place a pole on one of the public
streets, it shall be placed within the
sidewalk area next to the curb; and
provided further, that whenever any
person, or persons, have obtained
permission to use any of the streets
of the city for the purpose of re­
moving any building, the said
grantee, its successors and assigns,
upon 48 hours notice in writing
from such person or persons, shall
raise or remove any such wires,
which may obstruct the removal of
said building, so as to allow the
free and unobstructed passage of
same.
Section 6. The privileges, rights
and franchises herein set forth to
the said grantee, its successors and
assigns, shall continue for the term
of 25 years, and no longer, the term
commencing at the date of the
approval and acceptance of this or­
dinance, subject always to the terms
and conditions herein set forth.
Section 7. The said grantee, its
successors and assigns, shall, during
the life of this franchise, furnish a
continuous service of electric cur­
rent during 24 hours each day, ex­
cept when unable to do so by an un­
avoidable casualty or act of God,
and shall at all times use due and
reasonable diligence in maintaining
a continuous current of electricity
for lighting purposes to the City of
Hermiston and its inhabitants, and
shall hold the city harmless from
any and all damage by reason of the
erection of poles, buildings, or con­
duits, stringing of wires and opera­
ting under this franchise.
Section 8. Should the said grantee,
its successors and assigns, fail or
refuse to file its written acceptance
of this franchise within thirty days
after the final passage and approval
of this ordinance, then this ordin­
ance shall be null and void.
Sertlon 9. Any non-compliance on
the part of the grantee, its success­
ors and assigns, with any of the pro­
visions of this ordinance shall op­
erate to revoke the franchise hereby
granted, and at the option of the
city council by resolution, it shall
be the duty of the city council upon
any such failure or refusal, to at
once pass a resolution declaring this
franchise terminated and cancelled
and that thereupon this franchise
and all rights and privileges of the
grantee and its successors and as­
signs therein under this ordinance
shall be forfeited and this ordinance
shall be null and void.
Section 10. This ordinance shall
he in force and effect thirty days af­
ter Its passage by the Common
Council and approval by the Mayor.

further sum of $177.85, taxes paid,
with interest thereon at the rate of
6% per annum from the 18th day

num from the 9th day of December,
1937: and the further sum of $164.-
88. taxes paid, with interest there­
on at the rate of 6% per annum
from December 9. 1937; and the
further sum of $2.80 advanced by
plaintiff; and the further sum of
$750.00 as an attorney’s fee, and
the costs and disbursements of this
suit.
That the mortgage recorded Jan­
uary 11, 1924, at page 61, Book 83.
Record of Mortgages for Umatilla
County in the State of Oregon, be
reformed and corrected so that the
¡same shall cover the following de­
scribed land, to-wlt:
The West half of Lots 1 and 2
of the Northwest Quarter, and
the West Half of the Southwest
Quarter of Section 3 in Township
5 North of Range 3 5 East of the
W illamette Meridian.
Excepting therefrom five acres
in the Northeast corner of the
West Half of the West Half of

mette Meridian, and being about
564 feet long fronting on the
main public road and being 386
feet and 2 inches deep north and

Also excepting therefrom the

County, State of Oregon.
That said mortgage as so re­
formed and corrected be declared a
lien against said land and as re­
formed and corrected be foreclosed
That the Hens of Tax Receipts
Nos. 6357. 10399 and 10400, evi­
dencing payment of such taxes, be
foreclosed.
That said land be sold In the man­
ner provided by law for the sale of
real property on execution, and that

8 and two-thirds shares of stock of
Powell Ditch Company, a corpora­
tion, as represented by Certificate
No. 20, be sold with said land, and
that the purchaser of said land at
the sale thereof shall take said stock
certificate with the right to receive
from said Powell Ditch Company a
new certificate in lieu thereof and
in the name of such purchaser.
That plaintiff be permitted to bid
upon and purchase said land at the
sale thereof, and that the sheriff
should put the purchaser of said
land in possession thereof on the
date of sale.
That the proceeds of such sale be
applied in satisfaction of said sums,
Interest thereon, and costs and dis­
bursements, and if there be a defi­
ciency, then that plaintiff have exe­
cution against the property of said
defendants Bruce Shangle and Zel­
ma Shangle or either of them for
satisfaction of such deficiency.
That you and each of you and all
persons claiming by, through or un­
der you subsequent to January 9,
1924, the date of said mortgage, be
forever barred and foreclosed of all
right, title, interest, claim, lien or
demand in, to or upon said land and
said stock and each and every part
thereof, except the statutory right
of redemption.
This summons is served upon you
by publication thereof for four suc­
cessive weeks in the Hermiston Her­
ald. by order of Honorable C. L.
Sweek. judge of the' court above
named, which said order was made
and dated January 26. 1939, and the
date of the first publication of this
summons is February 2, 1939.
