cantly curtailed. This can
be seen as a reduction
in their traditional zon-
ing and planning pow-
ers, particularly in cases
where local objectives
clash with state energy
siting goals.
Mandatory Align-
ment with State De-
cisions: If the Energy
Facility Siting Council
approves a project that
doesn’t comply with lo-
cal standards, local gov-
ernments are required to
amend their regulations
to align with the state’s
decision. This top-down
directive compels local-
ities to accommodate
facilities that they might
have otherwise reject-

standards or local envi-

ronmental concerns.
Potential Conflicts
and Compliance Pres-
sures: Local governments
may face internal con-

directives with communi-
ty interests and environ-
mental protections. This
could lead to tensions
between fulfilling state
energy strategies and pro-
tecting local landscapes,
properties, and other lo-
cal values.
Strategic Planning
and Legal Challenges:
Localities might need
to strategically plan and
possibly reevaluate their
land use policies to en-
sure they have a say in
future energy projects,
knowing the state has
overarching authority.
This could also lead to
an increase in legal chal-
lenges as local govern-
ments and community
groups seek to assert their
interests.
Influence on Local
Decision-Making Pro-
cesses: Local authorities
may need to be more pro-
active in their dealings
with the state council and
developers from the out-
set of project discussions
to ensure their interests
and concerns are ade-
quately considered in the
state’s decision-making
process.
Potential benefits
may include
Streamlining energy
facility siting, ensuring
alignment with state-
wide planning goals, and
allowing for faster im-
plementation of projects
that contribute to ener-
gy security, economic
growth, and environmen-
tal sustainability. It also
prevents local disputes
from impeding the state’s
strategic vision for ener-
gy infrastructure.
The case sets a prece-
dent where state interests
in promoting energy in-
frastructure can override
detailed, locally tailored
land use plans, raising
concerns about the future
of local governance in
managing land resources

to local needs and val-
ues. This could lead to
broader implications for
how land use conflicts
are resolved across Ore-
gon, particularly in cases
where state-level energy
priorities intersect with
local land use policies.
In layman’s terms,
“friend of the court” re-
fers to an individual, a
group, or an organization
who is not a party to a
legal case but is allowed
to provide information,
expertise, or insight to
the court to help in mak-
ing a decision. This term
comes from the Latin
phrase “amicus curiae,”
which means “friend of
the court.”
