Immergut ruled that Ballot Measure 114’s per- mitting system does not violate the Second Amend- ment and therefore does not deprive Oregonians of their liberty. She also wrote that large capacity magazines “are not commonly used for self-defense, and are therefore not protected by the Second Amendment.” Immergut made the ruling in a 122-page opin- ion published late Friday afternoon, in which she said banning large capac- ity magazines and requir- ing permits to purchase firearms are in keeping with “the nation’s history and tradition of regulat- ing uniquely dangerous features of weapons and firearms to protect public safety.” State Attorney Gener- al Ellen Rosenblum wel- comed the news, saying in a statement that “Measure 114’s provisions are com- mon sense safety measures that will save lives.” However, the Oregon Firearms Federation called the ruling “absurd.” “Today, Judge Karin Immergut ruled against gun owners, the Second Amendment and a basic un- derstanding of the English language and ruled that Ballot Measure 114 is just fine,” the organization said in a statement said. Ballot Measure 114 passed in November by an extremely narrow margin, with 50.6 percent of the vote. Since then, several groups have filed lawsuits challenging the law. In Jan- uary, a state court judge in Harney County blocked the law from going into effect. Due to that ongoing court case, Measure 114 remains on hold for now. A state trial is scheduled for September in Harney County.
