WIND FARM SHUTDOWN

that Sany currently has all
legal permits to construct
the project and already has
spent more than $ 10 million
relying on the permits. The
Federal Aviation Adminis­
tration reportedly okayed
permits for the project and,
as part of the FFA process,
the Department of Defense
determined that the site
did not threaten national
security.
Furthermore, the Ga­
zette-Times has learned
that, because o f the cease
and d esist o rd er from
CFIUS, Sany has agreed
to sell the project to U.S.
citizens and has asked for
a 60-day extension under
which Sany would sell the
project within 60 days to a
U.S. citizen and, if not, it
would then cease construc­
tion. CFIUS reportedly re­
fused the extension request,
a move which is putting the
project developers under
stress to meet financing and
construction obligations.
Sany has reportedly
been in negotiations with
investment bankers who
are American citizens and
had reportedly reached a
verbal agreement to sell the
project to resolve the issue
of foreign ownership. Be­
fore a written contract was
finalized, however, CFIUS
expanded th eir interim
cease-and-desist order to
require that Sany equip­
ment cannot be installed on
the property and used for
the wind farms.
“By law, information
filed with CFIUS may not
be disclosed by CFIUS to
the public. Accordingly,
the Department does not
comment on information
relating to specific CFIUS
cases, including whether or
not certain parties have filed
notices for review.”

the way FSA reports a pro­
ducer’s farm program pay­
ments to the producer and to
IRS, Morrow County Farm
Service Agency (FSA) Ex­
ecutive Director Kyle Car-
nine announced this week.
In past y ears, IRS

issued to show all program
payments received from
the FSA, regardless of the
amount.
“Starting with calendar
year 2012, producers whose
total reportable payments
from FSA are less than
$600 will not receive IRS
Form 1099-G (Report of
Payments to Producers),”
said Camine. Additionally,
producers who receive pay­
ments from more than one
county will only receive
one 1099-G if the total of all
payments from all counties
is $600 or more, Camine
said.
“Producers who receive
less than $600 in combined
payments should consult a
tax advisor to determine if
these payments must be re­
ported on their tax return,”
she said.
If the payments were
subject to voluntary with­
h o ld in g s or su b ject to
backup (involuntary) with­
holdings, a 1099-G will be
issued regardless of the to­
tal amount of the payments,
Camine said.
The same changes will
apply to producers and ven­
dors who normally receive
IRS Form 1099-MISC from
FSA.
